there is a clause in every lease that refers to the "right to quiet enjoyment" , mainly as a warning to the lessee to be quiet and not disturb the neighbors.

However, failure of the lessor to maintain the premises per the rems of your lease (maintain YOUR right to quiet enjoyment) is a material breach of your lease and as such, with proper written notice, you can notify your landlord of breach and actually serve THEM with a three day notice.(a three day notice actually is a document that says "you are in breach of the terms of our contract. Within three days cure this breach or notify me of your intentions" It is not, as many believe, a notice to move out in three days.) Sound fun?

If you are on a month to month lease, the terms are that of the last lease document you signed.
