barnette v. west virginia determined that pledging allegience to a flag was offensive to jehovah's witnesses and therefore can't be made compulsory. the "under god" part just makes it even more obviously offensive to others group (atheists, agnostics, and non-monotheists such as buddhists and i'd guess wiccans).

but if the right wings just cleaned it up, they could make it totally compulsory, which is really what the they want, isn't it?
