would they not have to adhere to the rules and limitations that is upon the "employer"? Is this not simply sub-contracting and therefore the sub-contractor is subject to the same laws as the "contractor?

I don't see how the contractors can't be held responsible and be criminally prosecuted, they may not be subject to a military tribunal but I see nothing that prohibits criminal charges.
