is still a criminal.

There are a lot of folks that society feels should "know better"...however every day there is some elderly person getting robbed of their savings by an asshole who tells him/her that the roof needs a repair...So I guess since they are old and perhaps losing their ability to tell the difference between a "concerned person" and an asshole makes them ripe for the picking?

The same goes for people who are intoxicated....

There are loads of people who fall for scams for different reasons...but does that make the scammer less guilty?
