Even if Hank and Gomez weren't dead (and Jesse "missing" , they didn't feel they had a case without the money and the money is gone. Obviously they have a very strong circumstantial case against Walt, but they have nothing against Skyler except that her husband was/is a monster and that she had very good reason to be afraid of him.
Any half competent lawyer should have no problem getting her off. Keeping any of the money, even the car wash, probably isn't very likely, but she very much has plausible deniability and the added kicker of abused spouse.
