8. The problem with this... is it really a "new policy"?

Isn't it already the case that online-only students do not qualify for a student visa to be in the country?

If so... I think it's much harder to argue that the failure to change an existing policy is "arbitrary". I guess the question will be to what extent "guidance" can be considered as binding the policy-making body.
