That didnt exist over the last hundred years?
Im pretty sure you understand the conceptthe Supreme Court cant pass legislation.
On edit, I can think of at least one case of clear judicial activism, and that was Dred Scott. Ive seen folks argue that Roe created rights that werent in the Constitution.
