Because they gave him the power to redirect some funds if he declared an emergency.

The point here is that the choice to spend the money in the way he has is a bad decision... but it isn't unconstitutional. Congress could remove his authority to do it... but they gave him the authority.

The only way that changes is if a court blocks it.

Which isn't going to happen. SCOTUS slapped it down with a presumption that the suing group didn't even have standing.
