If Gates is convicted, maybe the judges behavior, even though it seems directed against the prosecution, can be used in the appeal.
As with Justice Kennedy, a) follow the money and b) what do Elliss Wife and kids do?

Gates isn't on trial, Manafort is and if he's found innocent he clearly cannot be retried.
