Takings clause changed by Kelo decision

Taking land by eminent domain should only be done for a public use according to the Constitution, however the justices agreed 5 to 4 that private property can be taken for a public benefit when they allowed Pfizer to take Susette Kelo's house because it would provide a public benefit by way of increased tax revenue. This decision paved the way to take native land protected by treaty for the public "benefits" of an oil pipeline. The deciding vote was Justice Kennedy. Now we actually need legislation to protect landowners from unfair takings.
