The Safe Third Country Agreement (STCA), in place since 2004, requires refugee claimants to request protection in the first safe country they reach.

But on Wednesday, a judge declared the deal unconstitutional due to the chance that the US will imprison the migrants. The ruling marks a major victory for Canadian immigration activists.

Lawyers for refugees who had been turned away at the Canadian border had challenged the agreement, arguing that the US did not qualify as "safe" for asylum seekers.

"We're all too familiar with the treatment that the US metes out to asylum seekers," Maureen Silcoff, president of the Canadian Association of Refugee Lawyers, told Reuters news agency.

Canada again tries to do the right thing for human rights. Unfortunately, the judge delayed the ruling for six months to allow Canada's parliament and the US Congress to respond. The ruling can also be appealed.

PORTLAND, Ore. (AP) — A federal judge heard arguments Wednesday on Oregon’s request for a restraining order against federal agents sent to the state’s biggest city to quell protests that have spiraled into nightly clashes between authorities and demonstrators.

The lawsuit, filed by Oregon Attorney General Ellen Rosenblum, alleges that federal agents sent by President Donald Trump have arrested people with no probable cause, whisked protesters away in unmarked cars and used excessive force to quell the unrest. It’s part of growing pushback against the Trump administration’s use of federal agents in Portland and its plans to do the same in other cities.

The motion for a temporary restraining order asks the judge to immediately command agents from the Department of Homeland Security, the U.S. Customs and Border Patrol, the Federal Protective Service and the U.S. Marshals Service to immediately stop detaining protesters without probable cause, to identify themselves before arresting anyone and to explain why an arrest is taking place.

During the hearing — held by videoconference because of the coronavirus pandemic — Rosenblum said she was asking the court to “declare it not acceptable for federal officers to use unconstitutional police state-type acts to detain citizens of Oregon without cause.” There are 114 federal agents in Portland, according to Steve Lippold, another attorney for the state.

The article goes to to detail another lawsuit to be heard on Thursday filed by the American Civil Liberties Union on behalf of journalists and legal observers who say they were targeted and attacked by police while documenting demonstrations.

An additional lawsuit has been filed accusing federal agents of violating protesters’ 10th Amendment rights by engaging in police activities designated to local and state governments. That legal action was filed by the Western States Center.

PHILADELPHIA (July 20, 2020) — District Attorney Larry Krasner on Monday issued the following statement on the Trump Administration’s verbiage claiming he may deploy federal law enforcement to American cities including Philadelphia:

“My dad volunteered and served in World War II to fight fascism, like most of my uncles, so we would not have an American president brutalizing and kidnapping Americans for exercising their constitutional rights and trying to make America a better place, which is what patriots do. Anyone, including federal law enforcement, who unlawfully assaults and kidnaps people will face criminal charges from my office. At trial, they will face a Philadelphia jury. It’s the least we can do to honor those who fought fascism, including those who are fighting it even now.”


The Philadelphia District Attorney’s Office is the largest prosecutor’s office in Pennsylvania, and one of the largest in the nation. It serves the more than 1.5 million citizens of the City and County of Philadelphia, employing 600 lawyers, detectives, and support staff. The District Attorney’s Office is responsible for prosecution of approximately 40,000 criminal cases annually.

Roy Den Hollander gunned down Judge Esther Salas' son in New Jersey on Sunday and badly wounded her husband. Den Hollander wrote on his website that the jurist was "a lazy and incompetent Latina judge appointed by Obama".

Den Hollander was a self-described "anti-feminist" lawyer who had sued nightclubs over ladies' night discounts, the federal government over a law protecting women from violence and a university over women's studies courses.

He also brought a lawsuit before Judge Salas in 2015 challenging the male-only military draft. In a 1,700-page memoir he published online, Den Hollander said he had "wanted to ask the Judge out, but thought she might hold me in contempt".

NBC News reports that he also wrote of fantasising about the rape of a female judge who had presided over his divorce case.


Hollander's body was discovered near Liberty in New York's Sullivan County, about 130 miles (210km) from the crime scene, according to CBS News.

Sonds like a typical Trumpster to me.

The U.S. Department of Homeland Security is crafting plans to deploy about 150 federal agents to Chicago this week, the Chicago Tribune has learned, a move that would come amid growing controversy nationally about federal force being used in American cities.

The Homeland Security Investigations, or HSI, agents are set to assist other federal law enforcement and Chicago police in crime-fighting efforts, according to sources familiar with the matter, though a specific plan on what the agents will be doing had not been made public. One city official said the city was aware of the plan but not any specifics.

One Immigration and Customs Enforcement official in Chicago, who asked not to be named because they were not authorized to speak on the matter, confirmed the deployment was expected to take place. The official noted that the HSI agents, who are part of ICE, would not be involved in immigration or deportation matters.

The Chicago Police Department issued a statement Monday: “The Chicago Police Department does not maintain any authority over the federal government’s deployment of federal law enforcement agents to the City of Chicago. We regularly work alongside our local and federal law enforcement agency partners toward the common goal of keeping Chicago residents safe,” the statement read. “If federal agents are deployed, it is critical that they coordinate with the Chicago Police Department and work alongside us to fight violent crime in Chicago.”

• In great news for us media types who law enforcement loves to tear gas and harass, U.S. District Judge Michael Simon has allowed the ACLU to lump federal officers in with the Portland Police in a lawsuit designed to make them stop targeting journalists (like the Mercury who's listed as one of the plaintiffs) as well as legal observers. Kelly Simon of the ACLU had this to say: "[Federal and local officers] cannot disperse, or target with direct force, those trying to document the truth about what is happening in our communities.”

• U.S. Attorney for Oregon Billy Williams has asked for an investigation into the federal officers (the same ones who swooped in and snatched up law-abiding protesters into an unmarked van) for detaining Portland civilians without probable cause.

• In a move that's not shady at all (jk, it's super shady), Portland Police Union boss Daryl Turner met with Trump cohort/DHS head Chad "CHAD!" Wolf who, by the way, refused to invite Mayor Wheeler or Police Chief Lovell to the meeting. Our Alex Zielinski has more on this totally shady meet-up.
