How Mitch McConnell pulled off a near-impossible impeachment feat

Analysis by Chris Cillizza, CNN Editor-at-large

Updated 8:41 AM ET, Fri January 31, 2020

(CNN)When the Senate impeachment trial began on January 21, two things seemed certain -- or at least very, very likely:

1) There would be witnesses called by both sides.
2) The trial would still be going when President Donald Trump came to Capitol Hill to deliver his State of the Union address two weeks later on February 4.

With Tennessee GOP Sen. Lamar Alexander's announcement late Thursday night that he would vote against calling witnesses, it now looks very, very likely that not only will there be no witnesses -- the first time that has been the case in a Senate impeachment trial -- but that the entire trial could wrap up by Friday night or early Saturday morning.

How? One man: Senate Majority Leader Mitch McConnell.

From beginning to (what looks like the) end, the Kentucky Republican has carefully -- and quietly -- executed a strategy designed to keep his conference in line on key votes.

It began with McConnell's power play earlier this month, announcing that he had 51 votes to move forward with the start of the Senate impeachment trial with no promises made on whether or not witnesses would be called or further documents would be sought. McConnell's opening gambit effectively knee-capped Speaker Nancy Pelosi, who had been holding on to the two articles of impeachment passed by the House late last year in hopes of extracting concessions from McConnell.

Senate ramps up investigation into IRS whistleblower's warning of interference with Trump or Pence a

Source: Raw Story

By Tom Boggioni

According to a report from the Washington Post, Senate investigators are moving forward and looking into a whistleblower complaint that an unnamed Treasury Department appointee has been interfering with IRS audits of President Donald Trump and Vice President Mike Pence.

The report states that the complaint was “first disclosed in an August court filing by Rep. Richard E. Neal (D-Mass.), the chairman of the House Ways and Means Committee, who said it raises ‘serious and urgent concerns’ about the system for auditing the president.”

Neal has filed a lawsuit against the Trump administration demanding the president’s tax returns, which Trump has refused to reveal despite promises made when he was campaigning for President.

Even as the president’s impeachment trial is winding down in the Senate, staffers for Sens. Charles E. Grassley (R-IA) and Ron Wyden (D-OR) have “conducted an extensive interview of a whistleblower at the Internal Revenue Service who has alleged improper political interference in the audit of the president or vice president, according to two people familiar with the meeting,” the Post reports.

Trump administration disguises plan to cut poor people's health care

By Emily Singer -January 30, 2020 4:36 PM

The administration is renaming its efforts to cut Medicaid as 'Healthy Adult Opportunity' grants.

The Trump administration on Thursday announced that it will allow states to accept fixed grant amounts to cover its poorest residents who obtain health care through Medicaid, a move experts say will ultimately lead to fewer insured Americans.

Republicans have long sought to implement what are known as "block grants" for Medicaid, which give states a fixed amount of funds to help cover the costs for residents enrolled in the program, rather than an open-ended funding stream.

In fact, block grants were a big part of Republicans' failed effort to repeal the Affordable Care Act back in 2017. Many protested the GOP repeal effort because those very block grants would be responsible for kicking millions of people off their health insurance.

However, despite the fact that the public roundly rejected the GOP's block grant proposal, Centers for Medicare & Medicaid Services administrator Seema Verma has been quietly working to offer block grants for more than a year, according to Politico.

Trump trial could end soon; Alexander says no to witnesses

Source: Associated Press

By LISA MASCARO, ERIC TUCKER and ZEKE MILLER

WASHINGTON (AP) — Republican Sen. Lamar Alexander of Tennessee declared late Thursday he will oppose calling more witnesses in President Donald Trump’s impeachment trial, all but dashing Democratic efforts to hear more testimony and boosting chances the Senate will vote quickly to acquit the president.

The retiring senator announced his decision by releasing a statement after senators finished a long question-and-answer session with the House Democrats prosecuting the charges and Trump’s lawyers defending the president. It’s a career-capping move by the 79-year-old lawmaker and former governor with a centrist streak in GOP politics.

At the same time, another key Republican, Sen. Susan Collins of Maine, said she would vote for more witnesses, but it would take four GOP senators to break with the majority and join with Democrats to tip the outcome.

Alexander, Collins and Lisa Murkowski of Alaska were playing an over-sized role in the final hours of debate with pointed questions ahead of crucial votes. Another, Sen. Mitt Romney, R-Utah, has made clear he will vote for witnesses.

“There is no need for more evidence,” Alexander said in his statement.

Justice Gorsuch wants to strip power from lower courts to help Trump

By Lisa Needham -January 30, 2020 5:40 PM

Supreme Court Justice Neil Gorsuch is making it clear he does not like national injunctions.

On Monday, the conservative majority of the Supreme Court issued yet another ruling the Trump administration had requested in an emergency capacity, something it has done over 20 times already. The Court rejected a lower court's decision to block the administration's "public charge" rule, meaning the administration is free to deny green cards to migrants who use might use public benefits, such as Medicaid.

The fact that yet another one of Trump's xenophobic policies is now in effect is bad enough, but there's more to the story. While the decision itself is unsigned — meaning the court just issued an order without saying who wrote it or explaining their reasoning — Justice Neil Gorsuch penned a concurrence, or agreement with the decision, joined by Justice Clarence Thomas, that expresses some very dangerous ideas about the role of lower federal courts.

In the concurrence, Gorsuch doesn't have much to say about the actual public charge rule. Instead, he uses it to complain about what he sees as the real problem: "[T]he increasingly common practice of trial courts ordering relief that transcends the cases before them."

What Gorsuch and Thomas are mad about are nationwide injunctions — where a lower court stops a federal law from going into effect across the entire country while litigation proceeds. A nationwide injunction typically occurs when a plaintiff, the person bringing the case to court, sues to block the law before it starts.

Though a concurrence doesn't have the force of law, Gorsuch is laying down a marker: He wants the Supreme Court to start restricting the ability of lower courts to block Trump's harmful agenda, even for the time it takes to litigate the issue. That way, the administration can continue to foist laws on the American people even while lower courts are still determining whether those rules are unconstitutional.

Graham: It's 'outrageous' to say we blocked witnesses after we blocked witnesses

Source: American Independent

By Dan Desai Martin -January 30, 2020 3:00 PM

Sen. Lindsey Graham (R-SC) blamed the House of Representatives for the fact that Republican senators voted to block witness testimony from the impeachment trial.

Sen. Lindsey Graham (R-SC), who voted to block subpoenas for witness testimony in Donald Trump's impeachment trial, said on Thursday that he considers it "insane," ridiculous," and "outrageous" to accuse Republicans of blocking witnesses.

"Of all the insane things being said about this impeachment debacle — and there is a lot to choose from — one of the most ridiculous is to say Senate Republicans are 'Blocking Witnesses,'" Graham wrote on Twitter Thursday morning. "This is an outrageous claim."

On Jan. 22, Graham joined his Republican colleagues in the Senate to vote 11 times to reject an attempt by Democratic senators to allow witnesses and documents to be a part of the impeachment trial. Graham voted against subpoenaing testimony from acting White House chief of staff Mick Mulvaney and former national security adviser John Bolton, among others.

On Thursday, Graham blamed the House of Representatives, "who refused to pursue the testimony of the witnesses," for his refusal to hear from additional witnesses. Graham alleged House members rushed the impeachment process in order to impeach Trump before Christmas 2019, insinuating it was their responsibility to hear from witnesses like Bolton.

Retired two-star US Army general slams Mike Pompeo and 'lightweight coward' Mark Esper: 'Disgusting'

Published 1 min ago on January 30, 2020

By Alex Henderson, AlterNet

In contrast to his predecessor, Rex Tillerson — who left the Trump Administration on very bad terms with President Donald Trump — Secretary of State Mike Pompeo has turned out to be as loyal and unquestioning a Trump supporter as Attorney General William Barr or White House Adviser Kellyanne Conway. Pompeo was at his most Trumpian on January 24, when he lashed out during an interview with NPR reporter Mary Louise Kelly: upset because Kelly brought up the Ukraine scandal, Pompeo resorted to yelling and cursing at her. And one of the people who believes that Pompeo is disgracing the position of secretary of state is retired U.S. Army Maj. Gen. Paul D. Eaton, a fellow graduate of West Point Military Academy.

The 56-year-old Pompeo graduated from West Point in 1986, while Eaton (who was born in 1950) graduated 14 years earlier in 1972. And as Eaton sees it, Pompeo’s bad behavior is unbecoming of a West Point graduate.

On January 28, Eaton lashed out at both Pompeo and Secretary of Defense Mark Esper on Twitter, posting, “Disgusting performance by @SecPompeo. Lightweight coward @EsperDoD. What is wrong with West Point class of 86? Who mentored you? What happened to the West Point Honor Code in your class? America is very badly served by these men.”

Eaton has made it abundantly clear that he won’t be voting for Trump in the 2020 presidential election and would like to see him voted out office: the West Point graduate has been an adviser to the Democratic political action committee VoteVets.

'You can't make this up!': Senate erupts in laughter when Adam Schiff reveals DOJ lawyers

just completely contradicted Trump’s impeachment defense

Published 1 min ago on January 30, 2020

By Cody Fenwick, AlterNet- Commentary

To defend against Democratic allegations of an illicit cover-up, President Donald Trump’s lawyers have argued fervently that the second article of impeachment in the Senate trial charging him with obstructing Congress is completely unwarranted. Instead of charging Trump with obstructing Congress, they’ve argued, Democrats should have taken the president to court to enforce subpoenas of his aides and requests for documents.

But on Thursday, a Justice Department attorney — who, ostensibly, works for the president — completely contradicted this argument.

There’s long been a tension in the president’s impeachment defense and his administration’s position in court, as many have pointed out. Trump’s impeachment attorneys have argued that Congress shouldn’t have charged Trump with obstructing their investigation but instead worked out disputes in the judicial branch. But when Congress has taken the administration to court to enforce its subpoenas, Justice Department attorneys have argued that judges can’t resolve the dispute between the legislative branch and the executive.

Basically, combining these two arguments, Trump’s lawyers are saying Congress should go to court to enforce its subpoenas, and then it should lose in court — essentially implying that lawmakers should have no power at all to compel evidence from the executive branch. If this were true, the power of impeachment would essentially be nullified.

I would really like to know why a senator has not requested John Bolton to testify and hand that question to John Roberts ..................................
And Adam Schiff should be in the US Supreme Court.............for starters and then the rest of Democratic managers should be on the federal bench........................since they understood what the rules of laws are and the Constitution..............

New video shows RNC's Ronna McDaniel warmly greeting indicted henchman Igor Fruman: 'Good to see you

Published 9 mins ago on January 30, 2020
By Brad Reed

A newly released video shows Republican National Committee Chairman Ronna McDaniel warmly greeting Igor Fruman, one of Trump attorney Rudy Giuliani’s former henchmen who has since been indicted on campaign finance fraud charges.

Politico reports that the video was taken by Fruman at a GOP donor event at President Donald Trump’s Mar-a-Lago resort in 2018, and it shows McDaniel seemingly showing familiarity with the now-indicted henchman.

“Good to see you — so glad you’re here!” she says as she approaches him.

Footage at the event also shows that Fruman was assigned a seat directly across from McDaniel, which suggests that the two had some familiarity with one another prior to the event.

Shortly after McDaniel greets Fruman, the president himself can be seen walking into the room.
