A bill authored by an Indiana lawmaker would reportedly force the Indianapolis Colts to offer refunds to any ticket purchasers who are offended because a member of the team kneels during the national anthem.
Such legislation, which effectively imposes a fine if private citizens express a political viewpoint the state disapproves of, violates the Constitution’s promise of free speech. As the Supreme Court explained in Boos v. Barry, laws prohibiting individuals “from engaging in classically political speech” strike “at the core of the First Amendment.”
Led by former San Francisco 49ers quarterback Colin Kaepernick, many NFL players began kneeling during the national anthem in 2016 to protest systemic racism in the United States. Such acts of protest are a form of “classically political speech.”

Senate GOP seeks to change rules for Trump picks

Republicans are mulling changing the Senate's rules to speed up consideration of President Trump's nominees.
GOP senators want to cut down the amount of debate time needed to confirm hundreds of the president’s picks, arguing Democrats are using the Senate’s rulebook to stonewall and slow-walk nominees and the GOP agenda.
Republicans have been privately discussing the potential changes for months, but support for the move appears to be growing amid mounting frustration about the pace of nomination votes.
“It merely shortens what is currently an unreasonably long process,” said Sen. Richard Shelby (R-Ala.), the chairman of the Senate Rules Committee.
The panel held its first hearing of the year before the holidays to discuss the measure from GOP Sen. James Lankford (R-Okla.).

States rushing to guard their 2018 elections against hackers may be on a waiting list for up to nine months for the Department of Homeland Security’s most exhaustive security screening, according to government officials familiar with the situation.
That means some states might not get the service until weeks before the November midterms and may remain unaware of flaws that could allow homegrown cyber vandals or foreign intelligence agencies to target voter registration databases and election offices’ computer networks, the officials said. Russian hackers targeted election systems in at least 21 states in 2016, according to DHS.
The scanning, known as a “risk and vulnerability assessment,” is the crème de la crème of security exams: DHS personnel come in person to do an intensive, multiweek probing of the entire system required to run an election. But department officials acknowledge that it’s of limited use if it doesn’t come soon enough for states to correct their flaws before voters go to the polls.

Private prison investors set for giant windfall from Trump tax bill
Individual investors in US private prisons are poised to collect their most lucrative earnings ever thanks to changes in the tax code signed by Donald Trump, continuing what has been a banner year for the industry since the 2016 election.
“It’s going to be great for the investors, banks and hedge funds that own shares in private prisons, and are dependent on increased incarceration and criminalization,” said Jamie Trinkle, campaign and research coordinator with the racial and economic justice coalition Enlace.
Under the new GOP law, investments in so-called “real estate investment trusts” (reits) will see a 25% reduction in tax, from 39.6% down to 29.6%.
Corecivic, formerly Corrections Corporation of America (CCA), and the Geo Group, which together own more than 80% of private prison beds in the US, both restructured as reits in 2013 after a private letter ruling by the Obama Administration IRS green-lit the change.
“This tax act is of unprecedented benefit for reit investors,” said David Miller, a tax partner at Proskauer Rose. “I think reits will explode in popularity as a result of this act.”
With dividends of more than $430m paid out by the two major private prison companies in 2017, in theory, prison investors could see an additional $50m in dividend earnings next year, thanks to the GOP legislation. The actual figure will be lower than that, however, as some proportion of those shares are owned by institutional investors which are taxed differently from individuals. The exact breakdown between the two is not available in public filings.
