Democrats are on a losing streak

By Richard Cohen
Columnist
July 8 at 6:18 PM

The bevy of Democrats running for president seems determined to test my silent vow never to vote Republican, especially for President Trump. The truth is that I cannot imagine that happening, but I can imagine entering the voting booth with about a colonoscopy level of enthusiasm. Please, can we get this over with?

At the moment, the party is squabbling over what is called forced busing to achieve school desegregation. It seems the party has forgotten that, with the possible exception of the Civil War draft, no program has been more hated by working-class Democrats — more whites than blacks, but plenty of blacks as well. In large U.S. cities, busing was seen as an effort by liberals to send white kids to schools they would not, for a moment, send their own kids to. In Boston, the spiritual home of the antibusing movement in the 1960s, the populace had not been as furious since King George III bivouacked his unwashed redcoats in the tidy homes of American patriots.

The leader of that antibusing movement was Louise Day Hicks , a wife, a mother, a lawyer and a fearsome racist firebrand. She rode the movement clear into Congress, and she came close to becoming Boston’s mayor, losing by only 12,000 votes. By then she had proved that busing was loathed in white, working-class America. Mobs formed in the streets, and the cops had to be called. Busing was sometimes the only remedy for school-board gerrymandering, which carved districts in such a way that schools were racially segregated. Since you could not move the schools, you had to move the kids. The law, not to mention equity, demanded it. Hicks and others, not to put too fine a point on it, did not give a damn about the law.

A Republican federal appeals court appears determined to strike down Obamacare

There was no law in New Orleans today
Ian Millhiser
Jul 9, 2019, 4:50 pm

NEW ORLEANS, LOUISIANA — A panel of two Republicans and one Democrat on the United States Court of Appeals for the Fifth Circuit heard oral arguments on Tuesday in a case asking them to repeal the Affordable Care Act in its entirety. The Democrat did not speak, although she remains overwhelmingly likely to reject this attack on Obamacare.

The Republicans, by contrast, came to court today wearing their partisan hats. When Samuel Siegel, the first of two lawyers defending the law, was at the podium for his portion of the arguments, Judges Jennifer Elrod and Kurt Englehardt peppered him with questions, many of them delivered in a mocking tone. At one point, Englehardt even accused Siegel of making an argument that betrays the American Revolutionary War.

Meanwhile, the three lawyers opposing the law did receive some critical questions from the two Republican judges, but those questions were not especially animated and they soon trailed off. Kyle Hawkins, the lawyer who delivered the bulk of the anti-Obamacare arguments, spent much of his time speaking before a silent panel, punctuated mainly by listless questions from Elrod that seemed designed primarily to give him something to talk about.

The most ominous sign of all is that the Republicans spent a considerable amount of time discussing what would be the appropriate scope of a court order striking the Affordable Care Act — a matter that obviously is only relevant if they intend to strike the law.

If an invading army committed such an act — If it killed 24,000 innocent people, year after year — we would name that act an “atrocity.” Resolutions would be debated in the United Nations Security Council. Peacekeepers would be sent to intervene.

But in this case, one of the greatest acts of mass killing to occur on American soil since the Civil War will not be committed by an army. It may, however, be committed by Jennifer Elrod and Kurt Engelhardt.

If the law permitted such a result, then perhaps it could be justified. But there is no law supporting such an outcome. It’s just pure, cruel ideology all the way down.

AG Barr suggests Mueller should defy Congress and refuse to testify

By
Dan Desai Martin -July 9, 2019

After lying about the Mueller report, Attorney General William Barr seems worried about Robert Mueller's congressional testimony.

Special counsel Robert Mueller is scheduled to testify before Congress on July 17, and Attorney General William Barr is suddenly hoping he won't.

"I'm not sure what purpose is served by dragging him up there and trying to grill him," Barr told the Associated Press on Monday. "I don't think Mueller should be treated that way or subject himself to that, if he doesn't want to."

Barr went further, according to Politico, saying the Department of Justice would absolutely support Mueller if he decided to defy Congress and not testify, even though Mueller is no longer a DOJ employee.

Barr's comments on Monday are a far cry from his statements to the press in April. On the day the redacted Mueller report was released to the public, Barr said he had "no objection to Bob Mueller personally testifying" about the report.

White House invents new excuse to stop former staff from talking to Congress

By
Lisa Needham -July 9, 2019

The White House keeps coming up with new ways to block its former employees from speaking about Trump's efforts to obstruct justice.

Another former White House employee has wasted the time of the House Judiciary Committee.

Annie Donaldson, former chief of staff to now-departed White House counsel Don McGahn, refused to answer over 200 questions from the committee. And she did so by invoking a type of privilege that seems to have been invented just for her.

For most of her refusals, Donaldson said that the White House had ordered her not to answer "because of the constitutionally-based Executive Branch confidentiality interests that are implicated."

No one knows what that means. There's no such formally recognized "constitutionally-based Executive Branch confidentiality" privilege that she or the White House can invoke. Functionally, it's just a long way of saying she won't answer the questions because the White House told her not to do so.

GOP women criticize their own party for not actually wanting to elect more women

By
Dan Desai Martin -July 9, 2019

The Republican Party is so sexist that GOP women wish their party would act more like Democrats.

There are more women who have credibly accused Trump of sexual assault or harassment (22) than Republican women who are serving in the House of Representatives (13). No wonder GOP women are dismayed at the lack of support they receive from party leadership, as the New York Times reported Tuesday.

"We are so welcomed in the background to help volunteer, to help spread information, but when it comes time for a woman to really step up into the spotlight, I almost feel like it's crickets,” Elana Doyle, a 26-year-old Republican contemplating a run for office, told the Times. "I admire that about the Democrats, how they embrace women and they put them on a pedestal and they say, 'We need you.'"

Democrats don't put women on a pedestal, but they do seem much more willing to treat women as equals who are capable of both running for office and being in leadership. And they recognize that actively recruiting and supporting women candidates helps overcome the structural barriers many women face to running for office.

After the 2018 midterms, the number of Democratic women in the House skyrocketed while the number of Republican women plummeted from 23 to a mere 13. While Republican leadership is dominated by men, Democrats elected Nancy Pelosi as Speaker of the House, and 10 additional women are in leadership roles. Further, five women are chairs of committees, including Rep. Nita Lowey (D-NY) as chair of the powerful Appropriations Committee.

Federal court tells Trump he can't block Twitter users for being mean to him

By
Emily Singer -July 9, 2019

Trump lost his appeal to a ruling ordering him to unblock people from his @realDonaldTrump Twitter account.

Special snowflake Trump can no longer block Twitter users who are critical of him, a federal appeals court ruled on Tuesday.

According to an opinion from the Second Circuit, Trump engaged in "prohibited viewpoint discrimination" and violated the First Amendment when he blocked users who made critical comments from viewing his @realDonaldTrump Twitter account.

That affirms a lower court ruling that already ordered Trump to unblock the Twitter users — a decision Trump had appealed.

"The First Amendment does not permit a public official who utilizes a social media account for all manner of official purposes to exclude persons from an otherwise‐open online dialogue because they expressed views with which the official disagrees," the Second Circuit wrote in its ruling.

From Nazis to hippies: End of the road for Volkswagen Beetle

By DAVID McHUGH 14 minutes ago

FRANKFURT, Germany (AP) — Volkswagen is halting production of the last version of its Beetle model this week at its plant in Puebla, Mexico. It’s the end of the road for a vehicle that has symbolized many things over a history spanning the eight decades since 1938.

It has been: a part of Germany’s darkest hours as a never-realized Nazi prestige project. A symbol of Germany’s postwar economic renaissance and rising middle-class prosperity. An example of globalization, sold and recognized all over the world. An emblem of the 1960s counterculture in the United States. Above all, the car remains a landmark in design, as recognizable as the Coca-Cola bottle.

The car’s original design — a rounded silhouette with seating for four or five, nearly vertical windshield and the air-cooled engine in the rear — can be traced back to Austrian engineer Ferdinand Porsche, who was hired to fulfill German dictator Adolf Hitler’s project for a “people’s car” that would spread auto ownership the way the Ford Model T had in the U.S.

Aspects of the car bore similarities to the Tatra T97, made in Czechoslovakia in 1937, and to sketches by Hungarian engineer Bela Barenyi published in 1934. Mass production of what was called the KdF-Wagen, based on the acronym of the Nazi labor organization under whose auspices it was to be sold, was cancelled due to World War II. Instead, the massive new plant in what was then countryside east of Hanover turned out military vehicles, using forced laborers from all over Europe under miserable conditions.

HONG KONG/WASHINGTON (Reuters) - The Chinese military commander responsible for Hong Kong has assured a Pentagon official that Chinese troops will not interfere in the city’s affairs – an apparent signal that they will stay in their barracks amid renewed political upheaval.

Trucks full of white-gloved People’s Liberation Army soldiers rolled into Hong Kong within hours of Britain handing its colony back to Chinese rule in 1997, sparking anxiety and raising lingering questions about their role.

Major General Chen Daoxiang was speaking at the start of a meeting last month with David Helvey, principal deputy assistant secretary of defense for Indo-Pacific Security Affairs, according to people briefed on the discussion.

Helvey met Chen on a courtesy call at in the PLA’s Hong Kong headquarters on June 13 – just meters from where a day earlier police clashed violently with protesters seeking to prevent the passing of a now-suspended bill that would allow people to be extradited to mainland China for trial.

Inspections ordered on some A380s after wing cracks found

PARIS (Reuters) - European regulators have ordered inspections on some older Airbus A380 superjumbo airplanes after some cracks were detected in wings on the world’s largest passenger aircraft.

The European Aviation Safety Agency directive, which formalizes an instruction from the manufacturer itself, covers part of the outer wing on the 25 oldest aircraft, which first went into service in 2007 with Singapore Airlines (SIAL.SI).

The company confirmed that small cracks have been found on the outer rear wing spars of early production A380 aircraft.

“We have identified the issue and designed an inspection and repair scheme,” Airbus said in a statement, adding that the ongoing airworthiness of the A380 fleet was not affected.

U.S. appeals court to take up constitutionality of Obamacare

NEW ORLEANS (Reuters) - The future of Obamacare could be at stake on Tuesday when a coalition of Democratic-led states and House of Representatives urge a federal appeals court to overturn a Texas judge’s ruling that the U.S. healthcare reform law is unconstitutional.

Republicans have repeatedly tried to repeal Obamacare, or the Affordable Care Act (ACA), since its 2010 passage, and while the Justice Department would normally defend a federal law, the Trump administration has declined to defend its constitutionality against a challenge by 18 Republican-led states.

A coalition of Democratic state attorneys general led by California Attorney General Xavier Becerra stepped into the void to defend the law. The House intervened after Democrats won control in November’s elections after many focused their campaigns on defending Obamacare.

A three-judge panel of the 5th U.S. Circuit Court of Appeals in New Orleans, including two judges appointed by Republican presidents and one by a Democrat, will take up a ruling by a federal judge in Texas last year that the entire ACA was unconstitutional.
