By Emily Singer -
May 22, 2019

Kellyanne Conway made a snide remark to House Speaker Nancy Pelosi during a tense meeting at the White House on Wednesday.

Kellyanne Conway could learn a thing or two about respect.

Conway, the top Trump aide infamous for spewing mendacious propaganda and "alternative facts," made a snide comment to House Speaker Nancy Pelosi on Wednesday following a tense meeting at the White House.

According to a report from the New York Times' Kate Rogers, Conway asked House Speaker Nancy Pelosi if she'd like to relay anything to Trump, who had just thrown a temper tantrum and stormed out of what was supposed to be a meeting with congressional Democrats on infrastructure.

"Respectfully, Madame Speaker, do you have a direct response to the president?" Conway asked Pelosi.

Trump officials plan to let homeless shelters deny equal access

By Oliver Willis -
May 22, 2019

The Trump team is pushing to turn homeless shelters into a venue for bigotry and discrimination.

The Trump administration has announced a new rule that will serve as a green light to bigots who want to discriminate against homeless people who are transgender.

On Wednesday, the Department of Housing and Urban Development, led by Secretary Ben Carson, released a plan that would revise the Equal Access Rule to allow shelters to turn away the homeless simply because of their gender identity or orientation.

The prior rule, published in 2012 under President Barack Obama, ensured that shelters and other programs would not be able to discriminate based on these criteria.

Just the day before, while testifying before Congress, Carson lied and said the department was "not currently anticipating changing the rule."

Barr complains that courts won't just let Trump do whatever he wants

By Dan Desai Martin -
May 22, 2019

Trump's attorney general has a real problem with federal courts upholding the law.

Attorney General William Barr is apparently very upset that courts are preventing Trump from breaking the law and ignoring the U.S. Constitution.

In a speech to the American Law Institute on Tuesday, Barr whined incessantly about federal courts issuing nationwide injunctions to stop the Trump administration from implementing policies that are likely unconstitutional.

The injunctions "frustrated presidential policy for most of the President's term with no clear end in sight," Barr said, adding that courts have issued a dramatically higher number of injunctions to stop Trump's policies than they have in the past.

Since Trump took office, federal courts have issued 37 nationwide injunctions to stop Trump policies from taking effect until they were reviewed further. During President Obama's first two years in office, that number was two.

Trump: I'm not doing my job unless Congress stops investigating me

By Oliver Willis -
May 22, 2019

Trump is refusing to do the work he promised on issues like infrastructure and drug prices as long as Congress keeps investigating his crimes and corruption.

Trump angrily stormed out of a meeting with House Speaker Nancy Pelosi and Senate Minority Leader Chuck Schumer on Wednesday after demanding that Congress stop investigating his administration's crimes.

"Trump walked in to meeting with Dems on infrastructure, did not shake anyone’s hand or sit in his seat," HuffPost reporter Igor Bobic tweeted Wednesday, citing a source familiar with what happened.

The Wall Street Journal reports that Trump will refuse to continue his promised negotiations with Democrats in Congress on infrastructure and drug prices until Congress finishes its investigations into him.

"[Trump] objected to the continued investigation of obstruction of justice, he said he cooperated and gave his side of the story, as we’ve heard before, said Sen. Dick Durbin (D-IL), who was present for the unprecedented meltdown.

Bipartisan lawmakers demand to know why Trump administration is releasing John Walker Lindh early

Source: Think Progress

The convicted former Taliban fighter is scheduled for May 23 release, well before his 20 year sentence is completed.

Josh Israel
May 22, 2019, 10:16 am

Nearly 18 years after John Walker Lindh was captured while fighting for the Taliban in Afghanistan, he is set to be released from custody on Thursday by the Federal Bureau of Prisons. And many members of Congress — including Republicans — are livid that he will not serve his full 20-year sentence.

Lindh, who moved from the United States to Afghanistan in 2000 to join the fight against the Northern Alliance, was captured in November 2001 while working with the Taliban. He pleaded guilty to two charges in February 2002: supplying services to the Taliban and carrying an explosive while committing a felony. Under the plea deal, prosecutors dropped several charge including material support of terrorism and conspiracy to commit murder, which could have carried multiple life sentences. Media outlets at the time branded him the “American Taliban.”

Now, Lindh is set to be released on probation, after serving just 17 years of his sentence. And Republican lawmakers are criticizing his early release, a decision that is up to the Federal Bureau of Prisons.

During a Fox News appearance on Wednesday, Rep. Michael Waltz (R-FL), a former counter-terrorism adviser to Vice President Dick Cheney (R) and a stalwart supporter of President Donald Trump, lambasted the Trump administration for the decision to release Lindh early and allow him to serve out the rest of his sentence on probation.

And then there is this delusional comment from what's his face........................

While the president has yet to explain why his administration is releasing Lindh early, he did tweet on Wednesday morning that his approval rating would be at 65% if not for special counsel Robert Mueller’s investigation.

Virginia backs Trump's transphobic justification for transgender military ban

Source: Think Progress

The commonwealth believes Trump's line that it's not a transgender ban.

Zack Ford
May 22, 2019, 12:04 pm

The state of Virginia has confirmed it will comply with President Donald Trump’s transgender military ban, which officially took effect last month after courts cleared the way.

Responding to an inquiry from ThinkProgress, Adjutant General Timothy Williams explained that the Virginia National Guard’s service members “must meet established Department of Defense (DOD) readiness standards,” including the expectations laid out by the discriminatory policy.

Williams proceeded to repeat the Trump administration’s description of the ban. “The new DOD policy doesn’t ban transgender individuals from service, and transgender service members may continue to serve,” he wrote. “The DOD policy states that anyone who meets military standards without special accommodations can and should be able to serve, and this includes transgender persons.”

This is incorrect. The administration’s policy explicitly requires that service members can only serve in their “biological sex.” This automatically precludes any transgender person from serving, including those who are already living in accordance with their gender identity. It also institutes a new form of “Don’t Ask, Don’t Tell,” for currently serving personnel who might come out as transgender. They will now be forced to choose between continuing their careers or receiving the medical assistance they might require to begin their transition. Transgender students completing their education at one of the military academies will also have no opportunity to serve in the military upon graduation.

Alabama House passes 'born-alive' abortion bill

"Infanticide” is a manufactured controversy started by anti-choice conservatives who want to limit reproductive freedom.

Elham Khatami
May 22, 2019, 10:12 am

Days after Alabama Gov. Kay Ivey (R) signed the nation’s most restrictive abortion ban into law, the state legislature took things one step further, passing a bill Tuesday that would criminalize doctors for failing to treat an infant “born alive” after an abortion or an attempted abortion.

Under the controversial bill, which now moves to the state Senate, doctors would face jail time of 20 years for failing to “exercise reasonable care to preserve the life of a child born alive after an abortion or attempted abortion.” The measure is not rooted in scientific evidence or medicine, nor does it attempt to solve a common problem. Indeed, babies born before 23 weeks of pregnancy rarely survive, according to the American College of Obstetricians and Gynecologists. Under current Alabama law, abortion is banned at or after 22 weeks of pregnancy.

The issue of infants being “born alive” and then supposedly killed, otherwise known as “infanticide,” is largely a manufactured controversy started by anti-choice conservatives who want to limit reproductive freedom. As Alabama Democrats pointed out on Tuesday, the state has no record of any such instances. Furthermore, the majority of abortions nationwide are performed within the first 12 weeks of pregnancy.

There are very rare cases in which the life of a fetus and the pregnant person are both at risk, with the only solution being to induce labor, even if it means that the baby will not survive. Under the Alabama bill, doctors would be forced to try to save the infant’s life or face punishment.

Trump just got awful news from a federal appeals court

Trump's judges don't have the votes to bail him out — at least not yet.

Ian Millhiser
May 22, 2019, 12:35 pm

BuzzFeed’s Zoe Tillman reveals some truly terrible news for President Donald Trump’s efforts to resist a congressional investigation into his finances.

To explain, on Monday, federal District Judge Amit Mehta ruled that Trump’s accounting firm must comply with a congressional subpoena seeking many of Trump’s financial records. Just as significantly, Mehta denied Trump a stay of this decision that lasts longer than one week. Thus, unless Trump’s lawyers can convince a higher court to issue such a stay by next Monday, the House Oversight Committee will soon know a whole lot more about Trump’s personal finances.

As Tillman reports, Trump’s request to stay Mehta’s decision will be heard by a motions panel consisting of Judges David Tatel, Patricia Millett, and Neomi Rao — at least assuming that this case proceeds through ordinary procedures and none of these three judges recuses. Tatel is a Clinton appointee. Millett is an Obama appointee. Rao is a Trump appointee. The case is Trump v. Committee on Oversight and Reform of the United States House of Representatives.

As Mehta explains in his opinion, Trump’s legal arguments are extraordinarily weak. Though “there are limits on Congress’s investigative authority,” Mehta wrote, those limits “do not substantially constrain Congress.” Rather, “so long as Congress investigates on a subject matter on which ‘legislation could be had,’ Congress acts as contemplated by Article I of the Constitution.”

There are many reasons why a congressional investigation into a sitting president’s finances is valid, and Mehta lists quite a few in his opinion, including the fact that “the requested records will aid [Congress’] consideration of strengthening ethics and disclosure laws, as well as amending the penalties for violating such laws.”

https://thinkprogress.org/trump-just-got-awful-news-from-a-federal-appeals-court-90ea60771ac8/

-snip-

But there’s only one of Rao on the three-judge panel. And Tatel and Millett are thoroughly normal people who most likely can be trusted to read the law in a normal way. Trump might get a dissent from Rao arguing that the law should not apply to him, but that’s all he’s likely to get.

That doesn’t mean that Trump will ultimately prevail in the Supreme Court — at least three members of that court bear far more resemblance to Rao than they do to Talel or Millett. But it does mean that Trump will need Chief Justice John Roberts’ vote to bail him out in this case. And Roberts’ vote is, at the very least, more uncertain than Rao’s.

Sen. Ron Wyden is tired of Republicans ignoring election security

The Oregon Democrat wants to lift the issue out of the "traditional Washington bicker fest."
Joshua Eaton
May 22, 2019, 8:00 am

Sen. Ron Wyden (D-OR) is tired of Republicans ignoring election security.

“[W]hat happened in 2016 could be really small potatoes compared to 2020,” said Wyden, an Oregon Democrat who sits on the Intelligence Committee.

Wyden is especially concerned that, as he said, “all of the political muscle is on the other side trying to protect the status quo.” Now he’s hoping to take his message straight to voters.

Fourteen other Democrats joined Wyden earlier this month to sponsor legislation that would force states to use hand-marked paper ballots and audit their election results. The bill, called the Protecting American Votes and Elections Act, would also set cybersecurity standards for voting systems and provide funding for states to implement the changes.

I guess Moscow Mitch would not want to have election security after all EN+ and that oligarch asshole just put over 200 million into Kentucky through David Vitter ( he got busted with lady of the night while being a US Senator from Louisiana) and his team have been linked to the Russian and his wife gets to be a federal judgeship, is not qualified to be anything and should be annulled from that bench ...............................
