Civil rights groups battle Trump in court to block legally dubious Census data grab

Civil rights groups in Maryland want to block an order from Donald Trump to obtain citizenship data through administrative records.

The U.S. Supreme Court decided a citizenship question won't be on this spring's census form, but that doesn't mean the fight over it has ended in courtrooms across the country.

In Maryland, civil rights groups are trying to block an order from Donald Trump to gather citizenship data through administrative records. In New York, other civil rights groups are seeking sanctions against Trump administration attorneys for not turning over documents related to the citizenship question's origins. Democratic lawmakers in the District of Columbia are fighting for similar documents, and Alabama officials are suing the Census Bureau to keep immigrants living in the country illegally from being counted during the process that determines the number of congressional seats each state gets.

All of the lawsuits touch on whether the number of citizens, instead of the total population, will be used for redistricting or apportionment — the process of divvying up congressional seats among the states after the 2020 census. Opponents say doing so would dilute the influence of minorities and Democrats, which they argue was the true intent of the Trump administration's desire to add a citizenship question in the first place.

The U.S. Constitution specifies that congressional districts should be based on how many people — not citizens — live there. But the legal requirements are murkier for state legislative districts.

Missouri court permanently blocks key part of voter suppression law

The court called the law 'misleading' and 'contradictory.'

The Missouri Supreme Court on Tuesday permanently blocked a central portion of a 2016 voter identification law that it said had required a "misleading" and "contradictory" sworn statement from people lacking a photo ID.

The 5-2 ruling upholds a decision by a lower court judge, who had blocked the affidavit requirement from being used in the 2018 general election. It had remained on hold since then.

Missouri is one of several states where Republican-led legislatures have passed voter photo ID laws touted as a means of preventing election fraud. In Missouri's case, the state law was accompanied by a constitutional amendment, approved by 63% of voters in November 2016, that authorized the implementation of a photo ID law.

Voter photo ID laws have been opposed by Democrats, who contend they can disenfranchise poor, elderly, disabled, and minority voters who are less likely to have photo IDs.

Dark money ads show same phony constituent complaining about 11 different Democrats

The American Action Network found one person who is upset about impeachment and presented her as a voter from eight different states.

A new ad being run by the pro-GOP dark-money American Action Network features a woman named "Stacy," billed as mom, wife, and teacher who is disappointed that her congresswoman, Rep. Xochitl Torres Small (D-NM), voted to impeach Donald Trump. Virtually identical ads being run in at least 10 other congressional districts feature the exact same woman presented as a constituent of other House Democrats.

In each of the spots, "Stacy" implies that she is a disappointed citizen from that lawmaker's House district. "Around here, we focus on what matters," she says, adding, "I just wish that [lawmaker's name] would let us decide the elections and get to work on the issues that matter."

The spots are part of the group's $2.5 million ad campaign aimed at punishing Democratic lawmakers who represent districts that voted for Trump in 2016 and voted to impeach him last month.

Sen. Marsha Blackburn (R-TN) is complaining that Democratic colleagues running for president against Trump cannot be 'impartial' when it comes to his alleged high crimes and misdemeanors.

Sen. Marsha Blackburn (R-TN) has dismissed the impeachment of Donald Trump as a "hoax" and said her colleagues should not trust anything the House managers present in the impending trial. But on Friday, she accused four Democratic colleagues of not being "impartial" because they are seeking the presidency.

Blackburn, appearing on Fox Business Network, argued that Sens. Bernie Sanders (I-VT), Elizabeth Warren (D-MA), Amy Klobuchar (D-MN), and Michael Bennet (D-CO) are each campaigning for the Democratic presidential nomination and thus must want to see him removed from office.

"When you look at the fact that these four candidates are spending hundreds of hours and millions of dollars to defeat Donald Trump and they take an oath to provide impartial justice," she said, "I think that is a difficult standard for them to meet." She noted that she thinks they should "step aside" from the trial."

"They got sworn in yesterday to be a juror, to provide impartial justice and they're going to be campaigning against him this weekend in Iowa," Blackburn continued.

Trump judge lashes out at a transgender litigant in a surprisingly cruel opinion

Federal appeals courts hear cases that impact the rights of millions. They decide matters with billions of dollars at stake. They sometimes hear cases where thousands of lives hang in the balance.

United States v. Varner is not one of those cases. The main thing at stake in Varner is whether three judges will treat a woman with courtesy or with needless cruelty.

Two of them chose the latter option.

The case involves Kathrine Nicole Jett, a trans woman who is incarcerated in a federal prison. (Jett does not appear to use the name “Varner,” but for the sake of clarity, this piece will refer to her case as United States v. Varner because that is the only name the courts have assigned to it.) Jett made a couple of requests from the federal judiciary relating to her transition from male to female. She asked that her name be changed on certain court documents from “Norman Keith Varner” to “Kathrine Nicole Jett,” and that judges hearing her case refer to her as a woman and use feminine pronouns.

US states sue Trump administration over drastic cuts to food stamp program

13 states file lawsuit over new measure they say could disqualify nearly 700,000 from federal food assistance

A coalition of 13 states, New York City and Washington DC are suing the Trump administration over new restrictions for food stamp benefits for unemployed Americans – a measure they say could disqualify nearly 700,000 from federal food assistance.

The new rule, introduced in December, would eliminate states’ discretion to waive work requirements in distressed economic areas, saving the federal government $5.5bn in spending over five years.

The lawsuit is the latest pushback by Democratic states against the Trump administration, as opponents criticize the president for what they say are proposed changes that target the poor, unemployed and those in large metropolitan areas.

In the suit, filed Thursday, states say that by limiting their discretion, the new rule would actually terminate “essential food assistance for benefits recipients who live in areas with insufficient jobs”.

The coalition includes states like Oregon, Nevada, Minnesota and more areas hit hard by economic decline and job scarcity. The suit claims cuts to food stamps benefits, known as the Snap program, would burden states with new administrative and economic costs from “the negative health effects of malnutrition and instability”.

NIJMEGEN, Netherlands — Dr. Elise Nillesen walks briskly toward a compact SUV striped in red and yellow, the evening twilight fading. She slides into the passenger seat, stethoscope tucked in her handbag and a small pharmacy in the trunk, and heads off into the chilly November night.

With her driver, Henry, who is trained in basic medical care, Nillesen roves the small Dutch city of Nijmegen as a one-woman primary health care clinic. Once they leave the hospital building that serves as home base, where Henry has set up a makeshift bed so he can catch some sleep between calls, they won’t return for hours.

The night starts at a block of rowhouses where a man is enduring severe pain. Nillesen recommends some diagnostic tests and tells him to call his regular doctor in the morning, to whom she will also send notes.

En route back to the hospital, she gets a new call: A middle-aged woman is worried about some chest discomfort. Henry makes a U-turn, and 15 minutes later they pull into a sleepy enclave of single-family homes. A young child waits at the door. After seeing the woman, Nillesen decides to call an ambulance. Henry pulls their SUV across the street and puts on flashing yellow lights while they wait for paramedics to arrive.

GOP Sen. Facing Tough Election Takes Trumpy Victory Lap After Calling Reporter A Hack

Sen. Martha McSally (R-AZ), who faces a tough election fight in 2020, took a campaign victory lap Thursday after calling a CNN reporter a hack.


The day started with a straightforward question from CNN’s Manu Raju, who approached McSally in a Senate hallway just hours after hundreds of pages of records from Lev Parnas’ iPhone were released publicly by congressional investigators.

“Sen. McSally, should the Senate consider new evidence as part of the impeachment trial?” he asked.

“Manu, you’re a liberal hack,” McSally replied. “I’m not talking to you.”

Raju asked if she would comment at all.

Pompeo Denies Knowing Parnas Or Anything About Yovanovitch Surveillance

In a Friday interview with conservative radio host Hugh Hewitt, Secretary of State Mike Pompeo finally addressed the alleged surveillance of former Ambassador to Ukraine Marie Yovanovitch, saying that he’d “never heard about this at all.”


“Until this story broke, the best of my recollection, I’d never heard of this at all,” Pompeo told conservative radio host Hugh Hewitt.

Pompeo also washed his hands of any association with Lev Parnas, the associate of President Donald Trump’s lawyer Rudy Giuliani, who provided a tranche of messages to Congress that included exchanges about getting rid of and tracking Yovanovitch.

“Never met him,” Pompeo said.

Eric Trump's wife Lara mocks Joe Biden's stutter

The former vice president has battled a stutter from childhood.

Lara Trump, wife of Donald Trump's son Eric Trump, mocked former Vice President Joe Biden's stutter at a "Women for Trump" event in Iowa Thursday night, calling the speech impediment Biden has suffered with since he was a child "sad."

"I feel kind of sad for Joe Biden, and you know that's when it's not going well for him right? Because I'm supposed to want him to fail at every turn, but every time he comes on stage and they turn to him I'm like, 'Joe can you get it out? Let's get the words out Joe.'" she said on stage. "You kind of feel bad for him."

Biden opened up about his stutter last year in an interview with a reporter from the Atlantic who also suffers from the speech impediment. Biden talked about how he spent years trying to overcome his stutter, which he said made him feel "shame" in his youth.

"Anger, rage, humiliation," Biden told the Atlantic, describing how the stutter made him feel. "A feeling of, uh—like I'm sure you've experienced—it just drops out of your chest, just, like, you feel … a void."

This is not the first time someone in Donald Trump's orbit has mocked someone with a disability.
