Trump urges judge to reject proposed gag order in federal election case

This motion/filing is truly sad and delusional. The lawyers repeat many of TFG's attacks and then claim that these attacks are protected by the First Amendment. The attorneys in effect let TFG dictate the terms of this filing and then found law review articles (not a strong source) and other material to try to support TFG's claims.

Donald Trump’s lawyers said Monday that a gag order proposed by prosecutors would unconstitutionally silence him during key months of the 2024 presidential campaign, urging a federal judge in Washington, D.C. to reject the proposed limits.

In a 25-page filing that mirrored some of Trump’s own heated political rhetoric, Trump’s attorneys said the former president’s attacks on potential witnesses, special counsel Jack Smith and even U.S. District Court Judge Tanya Chutkan herself are protected by the First Amendment and were not actual threats or incitement of attacks.....

Trump’s attorneys said there’s no evidence that any of Trump’s public comments about those witnesses have deterred them from cooperating with prosecutors or preparing to testify in the case.

“This is entirely unsurprising as President Trump has never called for any improper or unlawful action,” they wrote.

Trump’s lawyers also rejected the notion that his comments would influence potential jurors in Washington, D.C. Rather, they portrayed Trump’s comments as a necessary antidote to media coverage of the indictment itself and Smith’s comments connecting Trump’s actions to the violence that unfolded on Jan. 6, 2021, at the Capitol.

Trump Files Absurd Opposition to Jack Smith's Gag Order Request

This filing is truly delusional and nuts. Basically, TFG is the victim of a massive conspiracy and has to be able to fight back by posting any crap that he wants without limitation even is such material is designed to trigger his followers to commit violence.

Instead of agreeing to stop threatening people, Trump’s lawyers filed an opposition to Jack Smith’s request.

Trump’s lawyers claim that Donald Trump’s behavior has been appropriate and state that we shouldn’t believe our own eyes saying he has never threatened or intimidated anyone.

Trump’s lawyers say that Trump’s behavior is protected speech and normal behavior in which litigants engage.

In the ultimate gaslighting, Trump’s lawyers claim the real threat isn’t coming from Trump, but from the speaking indictment brought by Special Counsel Jack Smith.

Trump’s lawyers, apparently parroting their clients deranged social media posts, then argue in their legal brief there is a grand conspiracy by Jack Smith, President Biden, and the Department of Justice to silence Donald Trump. Trump's lawyers characterize the indictment as being brought by the "Biden Administration" and claim it is politically motivated because they say Biden is scared of Trump's poll numbers.

Andrew Weismann sued after saying lawyer coached Cassidy Hutchinson to lie to Jan. 6 committee

Former Mueller investigation prosecutor Andrew Weissmann is being sued by Stefan Passantino, a Trumpworld-paid lawyer who initially represented former White House aide Cassidy Hutchinson, reported The Guardian's Hugo Lowell on Friday.

Passantino alleges that Weissmann, a frequent legal commentator on cable news, defamed him when he said that he had "coached" Hutchinson to lie to the House January 6 Committee during her testimony.

Hutchinson gave bombshell allegations to the Committee about former President Donald Trump's activities on the day of the attack on the U.S. Capitol, claiming, among other things, that Trump demanded the Capitol take down security for the rioters because "they're not there to hurt me," and that he physically fought with his Secret Service driver when he refused to take him to the Capitol to join the rioters. Secret Service officials have disputed Hutchinson's version of events.....

But the allegations around Passantino are not isolated. Other attorneys who have been paid by Trump-linked groups to represent witnesses in investigations have also been accused of giving conflicted advice. Yuscil Taveras, an IT worker at the former president's Mar-a-Lago resort who reportedly witnessed the concealment of classified information, switched from a lawyer paid by Trump groups to a federal public defender, and changed his testimony as he did so.
