Bernie Sanders Backers Battle DNC in 11th Circuit

There were oral arguments in the amusing lawsuit brought by some JPR types against the DNC. This lawsuit claimed that donors are consumers under the DC consumer protection statute and some other amusing claims. The District judge dismissed this case for a number of reasons and the plaintiffs appealed. https://www.courthousenews.com/bernie-sanders-backers-battle-dnc-in-11th-circuit/

During oral arguments, U.S. Circuit Judge Adalberto Jordan seemed skeptical that certain counts in the lawsuit could proceed with respect to the Sanders donors’ alleged damages. The judge said it would be a stretch to show causation between those damages and the actions of the DNC, given that the DNC is an entity separate from the organization that accepted the donations – the Sanders campaign.

Judge Jordan further expressed reservations about the Sanders backers asking the court to hold that a political party has a fiduciary duty to its donors.

“You don’t have any precedent [in relevant jurisdictions] that goes anywhere close to what you’re asking us to do,” Jordan told Beck.....

In that August 2017 dismissal order, Senior U.S. District Judge William Zloch appeared reluctant to grant relief on matters concerning the internal workings of the Democratic Party.

“Grave questions regarding the DNC’s right of association would undoubtedly arise if this Court were to enjoin the DNC to a particular manner of governance,” the ruling states. “And those same concerns would arise with respect to any award of damages, which would impose liability for the DNC’s alleged decision to associate with a particular standard-bearer in a manner not otherwise prohibited by law.”

I read the briefs in this case and I was not impressed by the amusing claims of the plaintiffs. https://upload.democraticunderground.com/100210544462

The Trump Administration Just Asked The Supreme Court To Let It Enforce Its New Asylum Ban

Source: Buzzfeed

The Trump administration went to the Supreme Court on Tuesday, seeking an order that would allow it to enforce its new policy barring asylum claims by those who cross into the country without authorization.

Justice Elena Kagan has called for a response to the Justice Department's request by noon Monday, December 17.

On Dec. 7, the US Court of Appeals for the 9th Circuit denied the Justice Department's request to put the district court judge's injunction on hold.

The district court judge who halted enforcement of the policy change in the days before Thanksgiving, US District Judge Jon Tigar, faced backlash from President Donald Trump, who dismissively referred to him as an "Obama judge." That comment, in turn, prompted a rare rebuke from Chief Justice John Roberts.

Arpaio Sues CNN, Rolling Stone, HuffPost For Coverage Of Contempt Conviction

Larry Klayman is representing Arpaio in this bogus lawsuit https://talkingpointsmemo.com/news/arpaio-lawsuit-cnn-rolling-stone-huffpost

Former Maricopa County sheriff and presidential pardon recipient Joe Arpaio sued several news organizations and journalists for defamation and false light on Monday for allegedly misreporting the details of his contempt of court conviction.

But at least two of the three errors Apraio cited have been corrected, contrary to his suit’s claims.

In July 2017, Arpaio was convicted of contempt of court, a misdemeanor, for continuing his practice of targeting immigrants with traffic stops, defying a judge’s order. A month later, President Donald Trump issued the first pardon of his administration to Arpaio, saying that his “life and career … exemplify selfless public service.”

In the 10-page filing in Washington, D.C. District Court on Monday, Arpaio cites one CNN TV segment and articles from Rolling Stone and HuffPost, accusing them of recklessly getting the details of his case wrong. He also accuses them of failing to issue corrections — which is untrue, at least for Rolling Stone and HuffPost.

US appeals court won't immediately allow Trump asylum ban

Source: AP

The ban is inconsistent with an existing U.S. law and an attempted end-run around Congress, a panel of the 9th U.S. Circuit Court of Appeals said in a 2-1 decision.

“Just as we may not, as we are often reminded, ‘legislate from the bench,’ neither may the Executive legislate from the Oval Office,” 9th Circuit Judge Jay Bybee, a nominee of Republican President George W. Bush, wrote for the majority.

A spokesman for the U.S. Department of Justice, Steven Stafford, did not have comment. But he referred to an earlier statement that called the asylum system broken and said the department looked forward to “continuing to defend the Executive Branch’s legitimate and well-reasoned exercise of its authority to address the crisis at our southern border.”

At issue is President Donald Trump’s Nov. 9 proclamation that barred anyone who crossed the U.S.-Mexico border between official ports of entry from seeking asylum. Trump issued the proclamation in response to caravans of migrants approaching the border.
