A series of decisions by the Obama administration loosened the legal concept of gender in federal programs, including in education and health care, recognizing gender largely as an individuals choice and not determined by the sex assigned at birth. The policy prompted fights over bathrooms, dormitories, single-sex programs and other arenas where gender was once seen as a simple concept. Conservatives, especially evangelical Christians, were incensed.
Now the Department of Health and Human Services is spearheading an effort to establish a legal definition of sex under Title IX, the federal civil rights law that bans gender discrimination in education programs that receive government financial assistance, according to a memo obtained by The New York Times.
The department argued in its memo that key government agencies needed to adopt an explicit and uniform definition of gender as determined on a biological basis that is clear, grounded in science, objective and administrable. The agencys proposed definition would define sex as either male or female, unchangeable, and determined by the genitals that a person is born with, according to a draft reviewed by The Times. Any dispute about ones sex would have to be clarified using genetic testing.

(53,951 posts)Yet one more reason this misadministration HAS to go! I would say "before it is too late", but I fear we are already there, if not right on the cliff. I don't want a "Blue Wave", I want a fucking BLUE TSUNAMI! According to mythologies, G-d (and others) used a flood to wash away evil, so why can't we use a metaphorical one to do the same?!

(15,888 posts)I was fired from my job, evicted from my house, threatened by the police daily, and when I called the Illinois Department of Human Rights I was informed that people like me had none. No human rights at all. That's how I wound up moving to Seattle, the only city in the USA that actually has anti-discrimination laws that specifically included Trans folk.

Discrimination and hate for the different is not confined to the "Conservative" side of the aisle I fear.

(6,496 posts)Maybe you should repost over in GD. You'd get a wider audience. This seems to be going under the radar. So much bad stuff in a few days. This how Trump gets away with it all. He just overwhelms people.
