NORTH CAROLINA: Court Upholds Law Permitting Magistrates To Refuse To Issue Marriage Licenses

A federal judge has upheld a North Carolina law that allows magistrates to refuse to marry same-sex couples by citing religious beliefs.

The judge in Asheville dismissed a lawsuit filed by three couples, two gay and one interracial. The judge ruled that the couples lacked legal standing as taxpayers to sue and lacked evidence showing they were harmed directly by the law taking effect in June 2015. Still, U.S. District Judge Max Cogburn wrote there is potential someone could suffer real harm because of the law.

The plaintiffs’ lawyers filed notice Wednesday that they’ll appeal the ruling to the 4th U.S. Circuit Court of Appeals. North Carolina is one of only two states with such religious-objection laws that are being enforced. About 5 percent of North Carolina’s magistrates have filed recusal notices.

note to magistrates, judges, clerks, etc: if your "sincerely held religious beliefs" are sooooo sincere, get a job in a church.

MY sincerely held beliefs do not approve of MY tax money going to support hate-filled, ignorant, whining, asshole bigots.

of the South. Big employers at Research Triangle Park had 10s of thousands of diverse employees, great universities were producing open-minded citizens, and Governor Hunt was stressing progress. I lived and worked in Raleigh from 1979 thru 1983. What the hell happened?

A lady walked into her business, asked her where she was from and said to her, "sorry, I can't do business with you."

They moved to the Pacific Northwest and they love it here.

Republicans took over the Legislature--gerrymandered districts--and in 2012 McCrory (who was known as a moderate Mayor of Charlotte)
won the Governor's office. He then proceeded to turn hard right--supported by all the right wing bigots in the Legislature--and for the first
time in over 100 years Republicans controlled the State of NC.

Democrats HAVE to vote in every election: Republicans do.

It wasn't "upheld". They screwed up the case. Big difference. By saying that "there is potential someone could suffer real harm because of the law. ", the judge left the door open for future cases. Hopefully, someone with better merits and legal advice will step up and take down that mess of a law.

Since gay couples can get married the courts are saying that there is no harm for us to sue over. I think what needs to happen is that a gay person in a county that is served entirely by magistrates who refuse (there is one of those) needs to sue over the fact they can't use a magistrate for other purposes.
