Kim Davis, the defiant Kentucky county clerk, was found in contempt of court and taken into federal custody.
U.S. District Court Judge David Bunning ordered Davis, the Rowan County clerk, to be jailed on the contempt charges until she agrees to comply with multiple court orders to issue marriage licenses to same-sex couples.
The judge ordered her held indefinitely because he did not believe fines would be enough to compel her to follow the law.
Davis, an elected official, has argued that she should be exempt from following the U.S. Supreme Court ruling in Obergefell v. Hodges because she objects to same-sex marriage for religious beliefs.

This smells of an orchestrated performance. They will intentionally use her (probably with her consent) to file a suit against the state to establish a ruling that will help right-wingers break-down our constitutional protections. Much like what they did with Hobby Lobby.

(357 posts)Attorneys for the couples seeking licenses only sought fines. Nobody was asking for jail time. So why does judge Bunning, a staunch conservative and G. W. Bush appointee send her to jail?
National media will be touting her "persecution" for months if not years now.

(3,231 posts)But this is not a civil liberties issue. She's free to practice her religion, but she's violating the civil RIGHTS of others.
Did any clerks issue licenses for gay marriages before it was legal?? I don't think so. Breaking the law is not defending their liberty. She's allowing her church to send her to jail just for her right to discriminate. I hope she sees the light and realizes she's being played!

(40,416 posts)The KY legislature has no stomach for such a thing and at any rate is apparently won't meet again until Jan.
Fines won't work because she'd just do a fundraiser.
The only thing the judge could do here is to throw her ass in jail until she complies with the law and the multiple injunctions against her failure to abide by the law.
This is the best outcome.

(11,175 posts)The Kentucky Legislature could remove her from office, thereby upholding the rule of law but incurring the wrath of the Christofascists. The legislators would have to choose between honoring their oaths of office and protecting their own electoral prospects.
Unsurprisingly, no one is placing much hope in the Kentucky Legislature.
