BUFFALO, N.Y (AP) -- A Virginia businessman who authorities say aided a woman who renounced being a lesbian and fled with her daughter during a custody dispute says prosecutors shouldn't be allowed to use cellphone bills in their case against him.

Attorneys for Philip Zodhiates (zoh-dee-AH'-tehs) will try to have the bills thrown out during a hearing Tuesday in federal court in Buffalo, New York.

Zodhiates is charged with helping Lisa Miller take her daughter out of the country to avoid losing custody to her former partner, Janet Jenkins. ... Prosecutors say Miller and Jenkins broke off their civil union in Vermont in 2003 and Miller came to believe that her lesbian relationship was sinful.

Zodhiates is accused of helping Miller go to Canada via western New York and eventually to Nicaragua. He faces charges of conspiracy and international parental kidnapping.

BUFFALO, N.Y. (WIVB) – A Virginia man charged with helping a woman kidnap her own daughter appeared in federal court Wednesday. Prosecutors say the woman fled the country through Niagara Falls, crossing the Rainbow Bridge into Canada.

Virginia businessman Philip Zodhiates was arraigned in Buffalo Court accused of helping Lisa Miller flee the country in September 2009 with her then 7 year old daughter Isabella. “He played an instrumental role, he was one of the main actors. He participated in a conspiracy for that child to be removed against the law across the border,” said Assistant District Attorney Kathleen Lynch.

According to the indictment, Zodhiates helped Miller flee the country by traveling from Virginia to Buffalo and crossing the Rainbow Bridge into Canada. It’s believed the mother and daughter ended up in Nicaragua. “Lisa Miller did this with the assistance of other people in violation of law by obstructing another parent’s rights,” said Lynch.

The drama began in 2003 when Lisa Miller split from her partner Janet Jenkins after a 3 year civil union. The couple was living in Virginia at the time. Miller said she was no longer a lesbian. Jenkin’s lawyer said they two shared custody of their daughter, but Miller disappeared with Isabella shortly after she became a born again Christian and Mennonite. In a statement Jenkin’s attorney Sarah Star said: “Janet believes that her daughter is still in Central America in the company of Lisa Miller and the Amish Mennonite Community. She requests that anyone with further information about Isabella’s whereabouts or her well being contact the National Center for Missing and Exploited Children.”
