Judge rejects request by Seattle Mayor Jenny Durkan to quash recall effort

In a blow to Seattle Mayor Jenny Durkan, a King County judge on Wednesday denied a request by the mayor to have the court reconsider a ruling that allowed a recall effort against her to proceed.

In a five-page decision, Superior Court Judge Mary Roberts essentially said she could not rule as to whether the plaintiffs or the city responded appropriately when chemical agents were used to disperse protesters during chaotic demonstrations that erupted in Seattle in May in the wake of the death of George Floyd at the hands of four Minneapolis police officers.

"The Recall Petitioners and Mayor Durkan have each provided the court with compelling evidence of the incredible challenges faced by each in the past weeks; application of the court’s limited authority in this proceeding is not meant to diminish the presentations on either side of these important issues," Roberts wrote in the order. "Mayor Durkan’s motion for reconsideration is DENIED."

Earlier this month, Roberts issued a ruling that a recall petition filed against Durkan over her handling of recent police brutality claims could proceed. But in issuing that ruling, the judge rejected six of the claims presented by the plaintiffs in which they sought the recall effort. However, the judge did allow one of those claims to move forward.
