Daniel's Law - Discussion about applying the law

Daniel’s Law (P.L. 2021, c. 371) protects the personal information of active or retired judges, prosecutors, law enforcement officers, and their immediate family members. Government agencies, individuals, and businesses are prohibited from publishing the home address and telephone number of individuals who request protection under Daniel’s Law.


Our newly elected GOP Mayor I *think* has misinterpreted the law. She is using the law to remove planning board videos from YouTube and to not allow Council Meeting commenters to verify their address at Council Meetings. In addition - she is stripping our Borough web site of past meeting minutes and planning board/historic preservation committee minutes and approvals.

I have reached out to the program Administrator in Trenton via email, but I'm wondering how other municipalities are managing the law.

Covered Persons should only include the following:
Active and retired federal and state court judges, prosecutors, and law enforcement members may request redaction of certain personal information from the public-facing sites noted above.L

I take that to mean residents and business owners who do not fall under that definition - can be compelled to provide their address, and prior meetings CAN be maintained on public sources as long as the addresses of Covered Persons are redacted.

Am I wrong here?
