With all the evidence pointing out the similarities between the two songs, the judge said it was "perfectly obvious . . . the two songs are virtually identical". The judge was convinced that neither Harrison nor Preston consciously set out to appropriate the melody of HSF for their own use, but such was not a defense.

The case with on for over twelve years, due to many factors, and was further complicted by a former manager of Harrison's seeking personal profit (and perhaps revenge) using knowledge gained as Harrison's manager to advise the plaintiff, purchasing the company that owned the rights to He's So Fine.
Harrison admitted to "unconscious plagiarism ."

Bobbie Gentry "Ode to Billie Joe" from 1967
Jeanie C. Riley "Harper Valley PTA" from 1968
Both of these songs were made into movies in the 1970s.
The second of these two was partly a parody of the first.
The Beach Boys "Surfin' USA" from 1963
James Darren "Surfin' Craze"; the song was written in 1964 and Darren recorded it in 1965
