Durbin’s political sense is probably solid here.

It doesn’t help in an election to give your opponents that much ammunition

Jerry Naddler said we needed to increase the number of justices just today, so did Markey. Don’t know if Biden has gone there. ...pretty politically charged to make that kind of statement
