2. It would seem

a lawyer worth his salt could turn this skin marking practice into an assault charge. Once while working in the OR I had to testify in a case where the surgeon "signed his work", something I should also point out, he had done in the past. He took a marker and wrote his name large across a woman's abdomen he had just performed surgery on. He thought it was funny. Her lawyers made him stop laughing.
Sure its not a solution to the whole problem, but bringing this abhorrent practice out in the open would be a start.
