Fox legal analyst; Trump violated the law by appointing Matt Whitaker as acting attorney general

https://www.rawstory.com/2018/11/fox-news-legal-analyst-says-trump-violated-the-law-by-appointing-matt-whitaker-as-acting-attorney-general/

Fox News legal analyst Andrew Napolitano....explained that Whitaker was not confirmed by the Senate and therefore violates the law.

“Under the law, the person running the Department of Justice must have been approved by the United States Senate for some previous position. Even on an interim post,” Napolitano said.

Whitaker previously served in the United States Department of Justice during the George W. Bush administration as the U.S. Attorney for the Southern District of Iowa.

That is a position that requires approval by the Senate. Unless there is something in the U.S. Code that says a 'Acting AG' must be approved by the current Congress, or that puts a limit on how long that Approval lasts, I'm afraid tRump is within his statutory rights. <sigh>
