Ken Cuccinelli Appeals To Defend Virginia's Anti-Sodomy Law At Supreme Court

WASHINGTON -- Virginia Attorney General Ken Cuccinelli, the GOP's 2013 gubernatorial candidate, filed a petition Tuesday with the U.S. Supreme Court seeking to uphold Virginia's anti-sodomy law.

Cuccinelli wants the court to reconsider a March 2013 decision by the U.S. Court of Appeals for the 4th Circuit striking down the state's "crimes against nature" statute. The 4th Circuit ruled that the law did not pass muster in light of the Supreme Court's 2003 Lawrence v. Texas decision, which struck down the latter state's anti-sodomy law as an unconstitutional criminalization of Americans' sexual conduct. The Virginia law, however, remained on the books.

The 4th Circuit ruled in favor of William Scott McDonald, who was convicted in 2005 at age 47 under the Virginia statute for soliciting a 17-year-old girl to commit sodomy. That law broadly makes oral and anal sex a Class 6 felony. While such laws historically targeted gay men, they have also been used against heterosexual activity.

The three-judge panel ruled that an unconstitutional law could not be used to convict McDonald. It added that the Virginia Legislature could pass another law to criminalize sexual conduct specifically between a minor and an adult. The Lawrence ruling applied only to consensual adult conduct.

. . . The conservatives do not have the votes on this particular issue. Justice Kennedy wrote the very strong majority opinion in Lawrence v. Texas. Even if Roberts, Scalia, et al. wanted to overturn Lawrence, they know they can't unless the make-up of the court changes. And rather than risk losing yet another major gay rights case, the Court's conservatives will decline to hear the appeal. Mark my words.

USSC may or may not rule in the way that most here want. But they've paved the way for a Paul presidency, and he's as anti-gay as they come. There is not way this will not end up in criminalizing gay sex, as that is the goal of the religious right.

His plan is as simple as the preceding one, before the Civil War. That any state can vote to deny federal laws and discriminate to those within their confines. But now the HoR is federalizing discrimination against women. So he's taken it one step further.

These things are the goals of conferences he's been attending. He intends to have that robust Christian nation of the 1950's federalized. Unless Democrats unify and moblilize for 2014 and 2016, prepare for Libertarian utopia. Rand and Ron are the same animal. Rand is the new hero of the Daily Paul and 'certain liberals.'



This is going to keep on happening until we regain the majority in the states. Too many say there is no difference in the parties. The people who wrote these laws are Republicans.

But hey, stay home, if you don't think it can get any worse. It's not like they've been hiding what they intend.

Sounds like a conspiracy to overturn the rights of millions of Americans.

By co-founder of the Heritage Foundation, involved in the creation of ALEC, the Moral Majority, the Council for National Policy, the Krieble Institute, likely more.

And their plan to end the liberal influence through disenfranchising Democrats and minorites, consistently carried out by ruthless GOP operatives with a religious fanaticism which has never cared about or honored ethics, laws or rules. Which democracy requires.

Why would it, since they hate democracy and see it as evil, want government to serve their interests only and like the Confederacy, do not believe in the most powerful tenet of the Founding Fathers that they worked to create?

When the ruling came down that it was consensual sodomy, they still could have charged them both under their sodomy laws back then. They didn't. The rest of the country, even then, was laughing too much and they got very bad publicity.

"Virgina is for Lovers", but only if you are straight, married, and having missionary intercourse in order to procreate. That was the standard joke during this trial.

They want more of that?

Anybody have a clue on that? Just seems to me that this is way beyond politics or religious conviction.
