Trump lawyers say Stormy Daniels refused subpoena outside a Brooklyn bar, papers left 'at her feet'

NEW YORK (AP) Donald Trumps legal team says it tried serving Stormy Daniels a subpoena as she arrived for an event at a bar in Brooklyn last month, but the porn actor, who is expected to be a witness at the former presidents criminal trial, refused to take it and walked away.
A process server working for Trumps lawyers said he approached Daniels with papers demanding information related to a documentary recently released about her life and involvement with Trump, but was forced to leave them at her feet, according to a court filing made public Wednesday.
I stated she was served as I identified her and explained to her what the documents were, process server Dominic DellaPorte wrote. She did not acknowledge me and kept walking inside the venue, and she had no expression on her face. The encounter, prior to a screening of the Stormy film at the 3 Dollar Bill nightclub, has touched off a monthlong battle between Trumps lawyers and Daniels attorney that continued this week as the presumptive Republican nominees criminal trial began in Manhattan.
Trumps lawyers are asking Judge Juan M. Merchan to force Daniels to comply with the subpoena. In their filing, they included a photo they said DellaPorte took of Daniels as she strode away. Daniels lawyer Clark Brewster claims they never received the paperwork. He described the requests as an unwarranted fishing expedition with no relevance to Trumps criminal trial.

Then the dumbshit Dellaporte throws the papers on the ground "at her feet" as she's walking away. In a crowd. In front of a bar. At a movie premiere. No, that is not good service.
And there is no video. The dumbshit just took a PHOTO. And all the photo shows apparently is her walking away, with the papers on the ground. Per the article: "In their filing, they included a photo they said DellaPorte took of Daniels as she strode away." Pretty suspicious of him to only include a photo and not a video. Does his phone not have a video function? That photo of her walking away does not prove service. That's why process servers stake out a person's home and catch people as they're walking out or pulling their car out, where they can't claim they didn't see them.
But even if that bullshit attempt at service is sufficient, it should go nowhere. As also noted in the article:

(51,646 posts)Stormy is but one of the raunchy adulterous escapades Trump hid from the voting public immediately before the 2016 election. A much more central witness to Trump's scheme is David Pecker, who was a major accessory to the catch and kill of the stories on Trump's lasciviousness.
I can assure you, throwing papers on the ground as someone has their back to you walking away in a crowd is not good service in any jurisdiction.

She was at a crowded bar and surrounded by a lot of people. The process server saw her, but could not get close to serve her, so he just dropped the service on the floor and left. The claim of eye contact is bullshit. I go to bars and make eye contact with a lot of people, but that doesn't mean I purposely ignore them.

But the jury selection is going smoothly, with seven already selected and a good chance that the full jury will be seated today or tomorrow. So this is yet another attempt to delay proceedings. They are absolutely deathly afraid of getting to opening statements and witnesses. The other benefit for them here is to try to disqualify Daniels as a witness (which they have already failed at in multiple motions), because even after all this time, Daniels testifying to their affair under oath in open court is one of the things Trump most wants to avoid.

(32,706 posts)Stormy Daniels didn't break any laws, Chump did. Besides that, she probably misunderstood the situation, as any law-abiding citizen would have. She's a private citizen and she was unaccompanied by a lawyer, so she didn't know what to do.

2. Dropped at her feet is not serving. They must ask if they are who they are to be served and then present the subpoena.
3. Was there mutiple people there during alleged serving? If so, she may not know their presents as if any other fan, thus was not a proper service.
4. H-hour and we are now hearing about this?

When she was surrounded by people in a crowded bar. No indication she was even facing him when he threw the subpoena on the ground--a very stupid thing to do in a crowded area.
That is not proper serving process.

The judge had already told him to stop with that and of course they always refuse to comply with a first admonishment.

I think the court is afraid of what his goon squad would do if they put him where he belongs. I think the orange faker is banking on them making J6 look like a picnic in the park if they put him in jail so the courts are trying to avoid that.

But it took 6 months worth of escalating "warnings" and restrictions (including of phone/computer use as he was out on $250 million (yes "million" ) bail and staying at his parents' house.
He still defied the admonishments, continued to contact witnesses and the press (this was happening between around late January 2023 - July 2023), and the judge finally threw his behind IN JAIL until his trial (which meant from August 2023 - October 2023 or thereabouts if I remember correctly). He was ultimately convicted and sits in prison now (still whining).
