Donald Trump Fears He Could Lose His Prized Assets 'Forever'

Donald Trump fears he could lose his most prized assets "forever" if he has to come up with the money for a bond as he tries to appeal a $454 million civil fraud judgment against him.
Trump said on Thursday that he could lose his real estate empire for good if he's forced to mortgage or sell it because of a judge's order. On Truth Social, Trump called the judge, Arthur Engoron, "a true Trump Hater" who was forcing him to obtain a bond that "is not possible" given that underwriters are seeking cash and not property, where most of his wealth is.
"If I sold assets, and then won the Appeal, the assets would be forever gone," Trump wrote. "Also, putting up money before an Appeal is VERY EXPENSIVE. When I win the Appeal, all of that money is gone, and I would have done nothing wrong. The Crooked Judge, who has already been overturned 4 times on this case (a record!), fully understands this. He gave us a demand which he knows is impossible to do. "
A Monday court filing revealed that despite approaching 30 underwriters to back the bond, Trump could not find an insurance company to do so. Although he does not need to put up the $454 million to appeal Engoron's order from last month, failure to do so means New York Attorney General Letitia James could begin seizing Trump assets even as the appeals process plays out. Her civil fraud case accused him of deceiving banks and insurers by inflating his wealth on financial statements when trying to get loans and make deals.

(11,989 posts)The only way he loses something he mortgages is if he fails to make payments.
If he wins his appeal, he pays off the mortgages. If he loses his appeal, he'd have needed to mortgage the properties to come up with the money anyway. There's no new "risk" to him from taking mortgages, and virtually no cost except the interest on the money (which is currently accumulating regardless, at least if he were to lose).

(57,097 posts)... The SCOTUS has overturned circuit court decisions in 90% of all circuit courts since 2007, most of them have had well over 50% of their decisions overturned. The DC circuit court has had 100% of theirs over turned. Only four courts have zero reversals, the Armed Forces Court, The Federal Circuit Court, the 11th Circuit Court and the Federal District Court. Four out of 16 Federal Courts under SCOTUS.
https://ballotpedia.org/SCOTUS_case_reversal_rates_(2007_-_Present)
TFG is pissed off because none of the ninth circuit cases ruled against him have been reversed. Not one. However since 2007, they've been reversed 79% of their decisions. TFG's ain't had a reversal in his favor yet, except for those trying to keep him off of state ballots. And one or two that had very little effect anyways.

(10,878 posts)Is that he is so leveraged that he is really not a billionaire. He may not even be a millionaire. He is so in hock on all his properties that he could well be upside down. That would be exposed by NY trying to grab his properties & sell them.
How will the state recoup their lost money from the Orange Bankrupter? That could be really damn hard if he is indeed destitute.

(47,107 posts)Sometimes you can easily see Trump has been medicated.
He is low energy, talks slowly and seems to be in a bit of a daze.
Other times he is very angry and that is when he gets ugly and mean.
We may see him start to decompensate and his behavior, mood and thought
process are going to deteriorate even more dramatically.
And it is going to be made worse with the speed and tranquilizers.
I just don't see how he is going to make it to November.

(1,134 posts)He doesn't like it when he gets a taste of what losing a lawsuit is like that can cost someone a substantial portion of his livelihood.
Nobody deserves this more.
Bond up or pay up, you whinging fat pillock.
And? So? That happens all the time in the real world. Untold thousands of people have lost everything they had because they lost a lawsuit. You delighted in it happening to people who sued you. Now it's your turn in the barrel, sore loser.
And? So? Don't do things that make you lose expensive lawsuits, and you wouldn't need to file expensive appeals. You knew what the risks were when TIsh James sued you; however, you stupidly thought that you were above punishment and that people loved you too much and would be won over by whatever came out of your fool mouth to prepare for the possibility of losing. It never even occurred to you. But now it's here, and it's only your fault you were a con artist and that your rampant narcissism kept you from settling the case.
The chances of your winning on appeal are about as high as you growing a functional brain. The appeals court might, at most, reduce the award to some degree, but it will not go away. This is what happens when you bring temper tantrums to a lawsuit and the other side brings, you know, evidence.
He wasn't overturned. Overturned applies to the ruling, not to procedural matters. Four isn't even all that much in the average case, and nowhere near a record, you typical moronic liar. How many times did your motions lose? Hm. A bunch more than four times, Loserini.
You're the one who bragged that you're a billionaire and have $400 million in cash on hand. Don't be mad when he held you to that one. And don't be mad when a judge rules that you ripped off the people of New York for $435million, when there's evidence to back it up (not your worthless word), and when we all bloody well know how that sum is probably only a tiny fraction of what you actually owe the state. Even a moron like you knows you're getting off light here.
Also: You had every chance to settle, but you didn't. So now you face the full brunt of the law. Grow a pair and deal with it rather than annoying us with your puerile temper tantrums, you whingy titty baby of a sore loser.

(15,286 posts)He usually doesn't host his show on Fridays, but last night did a special on all Trump's legal problems in NY state.
He had Tim O'Brien and another lawyer who was well versed in civil judgement cases. They said that it was unlikely the AG would seize property because the ownership was convoluted in some cases. They cited 40 Wall Street as an example. Everyone believes Trump owns it, but he has only a "ground lease" meaning, iirc, he owns the land, but not the building. Trump Tower is a similar deal, he owns some space, but the condo buyers own most of the rest. They both said AG James will go after the most liquid assets first like the accounts Trump has with Schwab or the rent rolls.
