Donald Trump's Legal Request in E. Jean Carroll Case Rejected by Judge

The judge who oversaw Donald Trump's E. Jean Carroll defamation lawsuit has rejected the former president's bid to delay paying damages.
Trump's lawyer, Alina Habba, filed a motion on Friday urging Judge Lewis Kaplan to pause the former president's obligation to pay Carroll $83.3 million for statements made in 2019.
In a memorandum filed in court, Habba wrote that Kaplan should stay the judgment until at least 30 days after "forthcoming post-trial motions, which will be filed no later than March 7." She also said in a statement emailed to Newsweek: "The figure awarded to Ms. Carroll is egregiously excessive. The Court must exercise its authority to prevent... this absurd judgment, which will not withstand appeal."
But in a court filing dated February 24, Judge Kaplan denied the request, writing: "The Court declines to grant any stay, much less an unsecured stay, without first having afforded plaintiff a meaningful opportunity to be heard."

It may be that he is trying to stall until he can gain control of the bank account of the RNC and have that cash and future contributions free up some money for him. I doubt the MAGATS would find anything wrong with him doing that.
If the appellate courts start rejecting his appeals of motion denials from the trial courts in a more timely manner we might see even more desperation from him. The big question is will the Saudis etc. bail him out? Putin is a little strapped for spare cash right now. I'm expecting the next 7 months to be over the top with election shenanigans, fake videos and news reports etc. and it could be that his plea to the foreign "helpers" will be on the order of "See how much I showed you after I left office? Help me win and I'll show you way more than that."

He desperately wants to get to the election whole and untouched. If he wins, he can make all of this irrelevant.
If not, he won't stick around to find out.

(4,274 posts)it is the civil defamation case with E. Jean Carroll and is about the judgement already rendered and that specific appeal. My discussion is about the financial judgements and his strategy for that. The criminal trials are not what I was referencing. The financial cases going to the USC is doubtful and there is little to think the court will take an appeal on the financial cases. My use of the word might is about this specific case. They might use that step of appealing the denial of the motion or they may file a request for reconsideration with the trial court judge before that. See how the word "might" describes one of several possible avenues of action in a specific case rather than describing an overall philosophy?
