Trump aims to bar undocumented immigrants from counting toward House representation

President Trump on Tuesday issued an executive order that blocks undocumented immigrants from being counted in the 2020 census for the purpose of allocating congressional representation.
The order, which immediately prompted legal challenges, amounts to something of a workaround for Trump after the Supreme Court last year blocked the administration from adding a citizenship question to the decennial survey.
The rationale for the memo rests on the argument that the president has final say over transmitting the final census report to Congress and that the constitution does not explicitly define which persons must be included in determining apportionment.
"The discretion delegated to the executive branch to determine who qualifies as an 'inhabitant' includes authority to exclude from the apportionment base aliens who are not in a lawful immigration status," the order states. "Excluding these illegal aliens from the apportionment base is more consonant with the principles of representative democracy underpinning our system of Government.

Everyone else is 3/5:
Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons. The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct.

(7,404 posts)How can they determine citizenship for this purpose. Plus, it would have almost no effect on allocation of congressional seats, assuming that each state has a similar percentage of non-citizens. There is a fixed 435 members of the House. It sounds like a big waste of money on what would certainly be a nominal impact. California, Texas and Florida may each lose one seat and where those 3 seats might go is anybody's guess. But it depends more on how close some state is to gaining or losing a seat without this change than anything else.

Trump wants to shift more Congressional seats to the states he carried in '16. Many of these will flip in just over 3 months.

As long as they reside in the area, they are included in the count. It's needed to know if need to increase #schools, #grocery stores, etc.
