Arresting officer in George Floyd case taken into custody by BCA

Department of Public Safety Commissioner John Harrington announced the arresting officer in the George Floyd case has been taken into custody.

Former officer Derek Chauvin has been taken into custody by the Minnesota Bureau of Criminal Apprehension.

This is a breaking news story. KSTP is working to get more details on this story and will post updates as more information becomes available.

Minneapolis police officer Derrick Chauvin in custody after death of George Floyd

Minnesota Department of Public Safety Commissioner John Harrington said he just received information that the officer identified as Derrick Chauvin in the death of George Floyd has been taken into custody by the Bureau of Criminal apprehension.

There was no more information on charging, because that's in the jurisdiction of the Hennepin County Attorney, Harrington said.

Harrington only mentioned that one officer had been arrested; no word yet on the other three Minneapolis police officers who have been fired.

This has been a breaking news update.

officers, maybe three, "securing" George Floyd on the ground.

I think the lead officer there, with the knee most directly on Floyd's neck, is the one who's been taken into custody. But there's another officer closely at his right side, down in what looks like the same position as the lead officer, "restraining" George Floyd - who was HANDCUFFED, and already VERY well immobilized, on his stomach, and at least appearing as though he was ABSOLUTELY NO threat to the officers, much less to anybody else nearby.

And in the video, it looks like they are KILLING him. All three of those officers, AND the fourth one who remained standing, looking around (and allowing what very much looks like a murder) go forward. They ALL should be in custody.

The facts as we know them point to Murder 2. That said, it appears that the cop and his victim worked together at no fewer than 2 locations in Minneapolis. If I am the DA, and I get a whiff of a personal grudge, I charge the cop with Murder 1. At this point, however, I would wait and see how the case develops, but Murder 2 is in the bag based upon the video, and this cop should have been arrested on that charge some 24 hours ago. If that had happened, we might not have seen riots in Minneapolis, Denver, Louisville, and Columbus.

The Department of Public Safety Commissioner John Harrington, that is. The DPS overseas the Bureau of Criminal Apprehensions (BCA).

I missed the first part of the news conference. But at the end when the anchors did the wrapup summary of the news conference (of which several Minnesota officials spoke, including Harrington), they said Harrington called it a murder. Third-degree murder falls between manslaughter and second-degree murder charges. This murder is not based on having the intent to kill. Third-degree murder is often charged as a depraved heart or mind crime. This charge can arise when a person fires a gun in a crowd without intending to kill anyone, for example.

Second degree murder can be charged when a defendant intentionally kills another human being but the murder is not premeditated. Second-degree murder may result when a person kills out of an intense emotional response or impulse. Additionally, killing someone during a drive-by shooting, killing someone during the commission of a crime

Unless you can demonstrate an intent to kill, 2nd Degree is going to be a high hurdle. And, by the wording given here, 3rd Degree might also be a stretch. I think the likeliest thing you will see here is an "overcharge" (intended to be plead down) of 2nd degree. But that will be mostly for public consumption.

DPS commissioner calls George Floyd death a murder: 'That's what it looked like to me', 5/29/20

The death of George Floyd while in the custody of Minneapolis police has been called a murder by the commissioner of the Minnesota Department of Public Safety.

"The vast majority of the great people of Minnesota and the great people of Minneapolis who are still having their guts ripped out by the Floyd murder – and we'll call it a murder – that's what it looked like to me," said John Harrington.

"I don't want to prejudice this from a criminal perspective. I'm just calling it what I see at that point," the commissioner added while speaking about the state's response to protesting that has led to riots in the wake of Floyd's death.

It's the first time anyone from local law enforcement has publicly called Floyd's death a murder. It also comes on the heels of leaders from both the New York Police Department and Los Angeles Police Union condemning the police tactics used on Floyd.

Several lawmakers and politicians, including Mayor Frey, have called for the arrest of all four officers and the swift filing of criminal charges. Hennepin County Attorney Mike Freeman announced early Thursday evening that he was not ready to do so.

“We’re going to investigate [Floyd’s death] as expeditiously, as thoroughly and completely as justice demands,” Freeman said.

“Sometimes, that takes a little time and we ask people to be patient. We have to do this right.”

Freeman’s delay sparked criticism from Maryland State Attorney General Marilyn Mosby, who took issue with Freeman’s remarks about her state’s handling of Freddie Gray’s death in 2015.

"For Hennepin County Attorney Michael Freeman to use my office to justify his inaction on the tragic and public killing of George Floyd is shameful.

“Saying that there was ‘a rush to charge, a rush to justice’ in the Freddie Gray case is demonstrably false,” Mosby said. “I stand by the decision I made 12 days after Freddie Gray was killed. I didn’t have video footage of a murder — evidence any prosecutor would dream of.”

“Mr. Freeman needs to own his decisions and be courageous enough to decide whether or not to prosecute and pursue justice for the murder of George Floyd,” Mosby added.
