Cuomo Threatens 'Constitutional Challenge' If Trump Orders States To Reopen Too Early

Source: huff post

The New York governor said any such order would be “dictatorial,” a day after the president falsely claimed to have “total” authority over states.

New York Gov. Andrew Cuomo (D) on Tuesday threatened to sue Donald Trump if the president orders states to lift their stay-at-home orders too early and rushes to reopen the economy before the COVID-19 pandemic safely subsides.

The warning escalated the back-and-forth between state governors and Trump, who falsely declared his “authority is total” in a propagandistic press briefing Monday.

“If he ordered me to reopen in a way that would endanger the public health of the people of my state, I wouldn’t do it,” Cuomo said on CNN. “And we would have a constitutional challenge between the state and the federal government, and that would go into the courts. And that would be the worst possible thing he could do at this moment, would be to act dictatorial and to act in a partisan, divisive way.”........................

Trump responded in a tweet Tuesday, accusing Cuomo of “begging for everything,” and falsely claiming “I got it all done for him, and everyone else.”

“Now he seems to want Independence! That won’t happen!” Trump tweeted.....................................

But does he have to sue? Can't he just ignore the order? Is Trump going to send someone to everyone's house to make them go back to work?

Same with a dozen or more states. What's he going to do? Send the TR and her battle group to NY harbor?

He can sue and let it molder in federal court until it doesn't matter anymore. I love the irony. Using one of Donnie's own impeachment defenses against him.

He will come up with some order on something that the feds have narrow control over so he can say "See I did it!" That's the way he operates. Just like the president can't shutdown commerce within a state he can't open it either both violate the 10th amendment. Even Clarence Thomas would have trouble with that. It's bluster that's all Trump does and he's managed to make people realize something they have forgotten, the federal government does not have a lot of power internally. Power is vested in the states and the only reason the feds have power within a state is when the state allows it. We now have governors who have remembered they don't have to allow it.

The only one challenging the Constitution is Donnie. Cuomo and NY are well within their rights and settled law. It's a state issue. Not a federal one. Shit face has no say in the matter and quite frankly can go fuck himself.
