Federal Appeals Court Rules Seth Rich's Family Can Sue Fox News

Seth Rich’s family can sue Fox News over the retracted story it ran on a far-right conspiracy theory surrounding their son’s death.

A federal appeals court in Manhattan on Friday ruled against a previous district court’s order to dismiss their lawsuit complaint, arguing that the family, Joel and Mary Rich, could in fact sue over emotional distress they claim was caused by the May 2017 article. The article alleged that Seth Rich had leaked Democratic National Committee emails to WikiLeaks and implied that that move had resulted in his murder. The article was retracted a week later for not meeting Fox News’ journalistic standards.

Circuit Judge Guido Calabresi argued in the Friday ruling that the Riches had “sufficiently pleaded extreme and outrageous conduct” by the Fox News defendants.

In a statement shared with TPM Friday, Fox News expressed its condolences to the family but maintained the network was innocent of the allegations.............................

Remember how the family had repeatedly asked Hannity to shut up about their son but Hannity kept up his lies. months after months. I do not know if it involves Hannity in particular.

Because the parties’ disagreement at this time hinges primarily on the first prong, which is “the one most susceptible to determination as a matter of law,” id., that is what we focus on.

i. Extreme and Outrageous Conduct
The Riches argue that we should view the specific allegations in the complaint as a series of acts that, taken together, constitute extreme and outrageous conduct. This is so, they claim, even though each individual allegation alone might not be sufficiently outrageous—because, taken together, these acts might amount to a deliberate and malicious campaign of harassment. Alternatively, the Riches allege that the Appellees knew of their susceptibility to emotional distress, and their conduct became extreme and outrageous when the Appellees chose to proceed with their plan in spite of that knowledge. We agree on both counts. We thus conclude that, under either theory, the Riches sufficiently pleaded extreme and outrageous conduct.5

They fired him and "Hannity And Colmes" became "Hannity's America" overnight.

I used to watch the show back before MSNBC became a reality, and I remember the final days. During the push for GW Bush's first huge tax cut for the wealthy, Hannity worked the propaganda for the administration. Every single night Hannity would state: "93 million Americans will get a "$1500 tax cut. Alan Colmes would shake his head and point out that Hannity left out the important word "average", meaning most of it will go to the top leaving peanuts for the working class.

Hannity would pretend he didn't hear that and repeat it word for word the next night with Colmes chastising his deception once again. Needless to say, Hannity wanted a format where no one would fact check him and Murdock gave it to him. Unfortunately, Alan Colmes died a couple years ago in a case of divine injustice.

here he was bringing it up again earlier this year while blaming the dems and 'deep state' coup for the 'ridiculous' russian conspiracy attack on trump, and being sarcastic

My best guess is that this was actually an inside job that nobody wants to talk about. There was a name at one time attached the inside job. His name is Seth Rich. He is the guy who ended up being murdered shortly after all this happened and some people tried to make the case that his murder was payback for having engaged in this sabotage.

It was quickly dispensed with as another conspiracy theory fomented by a bunch of radical creeps that don't know what they're talking about.

That poor family couldn't mourn their child. His death was used for entertainment, fuck foxes attorneys who thought you could do this. Like the sandy hook parents, stop using others pain for profit. The worst pain a human can suffer.
