The Trump Administration Asked The Supreme Court To Legalize Firing Workers Simply For Being Gay

Friday's brief comes after the administration argued that federal law allows firing workers simply for being transgender.

The Trump administration took its hardest line yet to legalize anti-gay discrimination on Friday when it asked the Supreme Court to declare that federal law allows private companies to fire workers based only on their sexual orientation.

An amicus brief (1) filed by the Justice Department weighed in on two cases involving gay workers and what is meant by Title VII of the Civil Rights Act of 1964, which bans discrimination "because of sex." The administration argued courts nationwide should stop reading the civil rights law to protect gay, lesbian, and bisexual workers from bias because it was not originally intended to do so.

That view conflicts with some lower court rulings that found targeting someone for their sexual orientation is an illegal form of both sex discrimination and sex stereotyping under Title VII. Those courts have found, to illustrate the point, that a gay man wouldn't be targeted if he were instead a woman dating a man; thus he faced discrimination because of his sex.

But the administration said in its brief Friday that Title VII's ban on sex discrimination only prohibits unequal treatment between "biological sexes," as it argued last week in a related brief against transgender rights, in which the Justice Department said companies should be able to fire people because they are transgender as well.

Congress did not explicitly say that the meaning of sex in Title VII encompasses LGBTQ people, so, the administration argues, the law cannot apply to sexual orientation. Federal lawyers are asking the Supreme Court, for the first time, to explicitly limit the Civil Right Act's protections to exclude LGBTQ people.

This is not just an attack on GLBT folks, and cis-hetero person could be fired for not appearing to adhere to someone's idea of gender roles.

Over 30 and never married? Fired
Married with no children? Fired
Male with no interest in the Superbowl? Fired (I wish I could say I was kidding about this)

The GLBT community has created freedom for the rest of us. This is why we should support GLBT rights.

...and like every other Rethug*, they don't think the laws apply to them... especially the ones with wealth. They tend to look down on other LGBT persons that don't quite measure up to their "specifications."

You give them power and they abuse it by electing the most boorish POS ever to be elected to the highest office in the land.

So true. Most of them don't seem to have ever heard of the New Testament or don't realize that Jesus himself was a Hebrew rabbi (assuming he ever really existed).

And, if they do remember the New Testament, the whole St. Paul/Saul (of Tarsus) thing? He was not one of the original 12 apostles, but a Jew/Roman citizen who never actually crossed paths with Jesus, even though a good chunk of the New Testament was based on his writings. That those important bits always seem to get left out of their screeching always leaves me a bit gob smacked. For all their proselytizing about the faith, they don't really seem to know anything about it and its origins. (It's actually a very fascinating area of study, be you a believer or not, given how much of the evolution of our history revolves around the Christian faith.)

Asking this has nothing to do with MAGA. It doesn't help the economy or pay down the federal debt. Honestly, I don't even believe Trump gives two shits about gay or trans people, he just wants to lash out at those who don't support him. And a bone to the religious right.
