Alabama: pregnant woman shot in stomach is charged in fetus's death

A pregnant woman from Alabama has been charged with manslaughter after she was shot in the stomach during an argument, killing the fetus.

Marshae Jones was reportedly five months pregnant when she was shot by another woman in December outside a shop in Pleasant Grove, near Birmingham.

On Wednesday, Jones, 27, was indicted by a Jefferson county grand jury on a manslaughter charge and is expected to be held in Jefferson county Jail on a $50,000 bond, while the woman accused of shooting her walked free, reported AL.com.

The case has raised alarm among pro-choice groups who say it is shocking evidence of how the state’s restrictive abortion laws are now being used against pregnant women.

and they shoot you in self defense, you aren't considered 'the victim'. That's the law; it has nothing to do with you being armed, or not. If I'm carrying a firearm (I don't) and am attacked by someone, and I shoot them, they are not 'the victim'. People who don't like this really should not start fights.

A description of the fight that indicated why it escalated to the level of using lethal force.

From what I have read in the many threads on this is the woman who was shot started a fight and continued to attack the other woman as a third party tried to separate them. The woman who was attacked then fired a gun. The rest of the details have not been made clear.

Usually the party that initiates a fight is deemed the assailant and the other party is the victim. This terminology continues even if the assailant ends up getting the worst of the encounter.

The law pretty much states that if you attack someone first, you are responsible for any and all injuries to *ALL* parties resulting from whatever happens as a result. It would have been the same (in the legal sense) if a patron on the next barstool over got shot instead: the instigator is considered the person at fault.
