So there were 32 Senators. Now there are 100. Winning by 1 vote meant a much higher percentage back then.

A 24 - 23 vote means the winner won by 51%. Today's vote of 50 - 48 means the winner won by 51%.
So the 1800s justice was confirmed by the same narrow 51% margin as Kavanaugh.

(13,059 posts)They are not that stupid. As long as Roe remains in force it will give them the same talking point they have used for years to keep winning elections. Their base will remain riled up over Roe and they will keep going to the polls to vote Republican. Overturning Roe takes that all away.

(13,059 posts)Our only recourse is to start winning more elections, especially presidential elections. A President Elizabeth Warren would have the opportunity to change the balance on the Court back to where it should be.
The investigation needs to go forward, somewhere, there is stink to be discovered about this man. I hope it is found and he is forced to resign. The only consolation is this man will still never coach kids again or teach in a public university.

(51,787 posts)The Kavanaugh majority will determine that the "undue burdue" test on abortion regulations will never be met, that virtually any abortion regulation will not amount to an undue burden on abortion.
That is how Kavanaugh ruled in the case of the 17 year old immigrant girl who wanted an abortion. He ruled that requiring her to first get a government-assigned sponsor (something she had been unable to do) was not an undue burden. If needlessly requiring the impossible before she can get an abortion is not an undue burden, nothing is.

If justice was served, The USA would be still respected around the globe. Have the first female President ever. Have a Democratic House, maybe Senate. But also, have a SCOTUS with Garland and some other justice put forth by Hillary Clinton, a clear majority of moderate and sane justices for decades. Paris accord would be adhered to. No nasty attacks on allies. The ACA fixed and strengthened, and perhaps opened up to a public option as a stepping stone towards single payer. None of the Obama accomplishments dismantled.
Its so extra depressing not because Democratic policy was simply stalled, but that it was literally reversed, gas pedal floored, and gone crashing into other cars houses people. sigh.

The one scandal of a large catalog that united the country across almost all demographics was locking up children in cages. I hope that we can somehow remind people what it felt like when they first heard a 6 year old child crying for their mother, surrounded by chicken wire. I know I will never forget.

Hopefully that will cause enough people to pull their heads out of their ass finally and maybe we will start seeing these assholes get voted out of office.
