Governor Kate Brown said she will refuse any order from President Donald Trump to send Oregon's guard troops down south to the US-Mexico border.

Trump wants National Guard troops sent to the Mexican border as his effort to build an impenetrable wall stalls because his administration is struggling to secure enough funds from Congress or other sources. He originally said Mexico would pay for the wall, but it has refused.

In a presidential memorandum authorizing the request of deployment of Guards to the border, Trump says U.S. security is "imperiled by a drastic surge of illegal activity", in particular drug trafficking by gangs and unlawful immigration.

He said it is a "crisis" of "lawlessness" at the southern border.

The president can federalize the national guard. Then the governor will have no say. That is what Eisenhower and Kennedy did to fight the white haters. Too bad this isn't about that.

If the National Guard is federalized, they are federal troops and subject to the Posse Comitatus Act and therefore prohibited from law enforcement activities. The justification for Eisenhower's use of active duty federal troops and the federalize Arkansas National Guard to enforce enforcement of integration orders was the Enforcement Acts of 1870 and 1871 (the anti-Klan acts) which would not be available to guard the border. Federalized National Guard troops could be used for surveillence, intelligence, logistic, etc. support but could not detain people at the border.

National Guard troops under "state orders" are not subject to the Posse Comitatus Act. Under an inter-state compact, National Guard troops from one state can perform law enforcement activities in another state. There are serious questions about what is included in law enforcement activities, e.g., is driving a bus load of arrested people law enforcement. The only way to avoid these problems is to have the National Guard under "state orders" which requires the cooperate of the Governors.

Regardless of party, Governors ought to be concerned about how the Guard troops - and the family, friends and employers - will respond to mobilization to the border (hardly a prime vacation site) when there is no real crises.

Bankrupting entities is about the only thing he knows how to do successfully. He said Mexico was going to pay for the "Wall". Mexico said "F^ck You. We're not paying for any damn wall." The GOP Congress needs to grow a pair. At the current pace, the only thing the Dotard is going to do is bankrupt this nation and we won't have shit to show for it. No health care. No new infrastructure projects completed. No handle on the National Debt that they ran up to pay for their tax cuts that benefited the top 1%.

When are the men and women of the GOP Congress going to say enough is enough? The vast majority of the island of Puerto Rico, a U.S. Territory, still looks like shit all these months later, while Houston is steadily being rebuilt. Half the population has fled to Florida and other states in the U.S. to overload the resources in those states. Now mind you, I'm not blaming them; I'm just pointing out the fact that the Dotard in charge with the 5 minute attention span has dropped the ball, and his pussies in the GOP Congress have dropped the ball; and I hope we Democrats will remain vigilant in Nov 2018 and Nov 2020, rather than get bogged down in 'food fights with one another' and run those bastards out of Washington.

They have no new ideas, and no backbone, so their current plan is to make the 2018 Election a referendum on Hillary Clinton again; which is what a one-trick pony does, keep playing the same old song over and over again and convincing the electorate that there will be a different outcome.

come november election? I think he is a sick enough individual to call up guard units from california, New York, Illinois and Mass.....and not ones from Tennessee, Kentucky, Mississippi and Texas...


just saying, no new trump/republican voter is going to be created in the ranks of national guard units serving in 120deg summer temps and their familes

Title 10 service means full-time duty in the active military service of the United States. The term used is federalized. Federalized National Guard forces have been ordered, by the President to active duty either in their reserve component status or by calling them into Federal service in their militia status. There are several forms:

Voluntary Order to Active Duty.

Federalized with the soldier's or airman's consent and the consent of their Governor.

Partial Mobilization.
In time of national emergency declared by the President for any unit or any member for not more than 24 consecutive months.

Presidential Reserve Call Up.
When the President determines that it is necessary to augment the active forces for any operational mission for any unit or any member for not more than 270 days.

Federal Aid for State Governments.
Whenever an insurrection occurs in any state against its government, the President may, upon the request of its legislature or of its
governor call into Federal service such of the militia of the other states. This is a statutory exception to the PCA(Posse Comitatus Act)

Use of Militia and Armed Forces to Enforce Federal Authority.
Whenever the President considers that unlawful obstructions, assemblages, or rebellion make it impracticable to enforce the laws of the United States in any state or territory, he may call into Federal service such of the militia of any state. This is another statutory
exception to the PCA(Posse Comitatus Act).

Interference with State and Federal law.
The President, by using the militia or the armed forces, or both, or by any other means, shall take such measures as he considers necessary to suppress, in a state, any insurrection, domestic violence, unlawful combination, or conspiracy.

Air and Army National Guard.
Air and Army National Guard can specifically be called into Federal service in case of invasion, rebellion, or inability to execute Federal law with active forces.

In the categories listed above, Army and Air National Guard units or individuals may also be mobilized for non-combat purposes such as the State Partnership Program, humanitarian missions, counter-drug operations, and peacekeeping or peace enforcement missions.

If he does then the federal government has to foot the bill, and that money is probably not in the current budget!

the border right now when crossings have dropped dramatically—all so he can get his stupid border wall built with money that should be going to upgrade our antiquated infrastructure.

If he wants a testament to his presidency, modernizing and repairing our railroads, bridges, airports, electrical grid, water delivery system, roads, et al would do way more than wasting money building a stupid wall.

He's too dense to get that though.

For years, Republicans have courted the xenophobic crazies as their base. Years.

Yet, during those same years, business owners who have exploited illegal immigrants for years to do stoop labor in agriculture while the GOP had law enforcement turn a blind eye.

Now, they will lose one or the other at the polls.

Same with the trade war. That's red meat for the base, but ironically they will be the ones who lose the most from it, because Trump just isn't very smart and China can run circles around him. So the rest of us will suffer.

These idiotic actions by Trump are alienating the right-leaning independents in droves. He still has the base but the rest of us seriously outnumber them.

The more I like and respect her. I think she would be a great candidate for higher office. She's not scared of trump , like the GOP are, and she is very smart, articulate, and wonderful personality from what many say, even her opponents says good things about her. She's shown what governance is all about. She's more capable of the job then orange goo has ever been, and now stating she'll not send her Guard down to the border , and they should be thankful, because it'll be like it was before. They'll be down there on their own , with no support system at all. Good to see her get more national exposure. Trump will be scared of her. He hates powerful and smart women. She's very likable, unlike him. Run Kate run.
