A federal grand jury in California indicted Jose Inez Garcia-Zarate, the undocumented immigrant accused and acquitted of the 2015 murder of Kate Steinle, for possession of a firearm and ammunition on Tuesday, the Department of Justice announced.
Garcia-Zarate, according to the agency, violated state immigration and gun laws by possessing "a semi-automatic pistol and multiple rounds of ammunition" as an undocumented immigrant and felon.
If convicted on the charges, he faces a maximum sentence of 10 years in prison, the Justice Department said in a joint statement with U.S. attorney Brian Stretch and the Bureau of Alcohol, Tobacco, Firearms, and Explosives' special agent in charge Jill Snyder. Garcia-Zarate is currently in state custody on other charges.
On Thursday a California jury found Garcia-Zarate not guilty of slaying a woman on a San Francisco pier two years earlier. The incident surrounding Garcia-Zarate, a Mexican-native and seven-time felon who had been deported from the U.S. five previous times, sparked a national debate about the state of immigration and was frequently cited by President Donald Trump during his presidential campaign.

(675 posts)No way this charge sticks, Garcia-Zarate had no idea he was picking up a gun when he grabbed the cloth under the bench. Accidentally picking up an object is far from "possession"
This whole event is a tragedy, if anyone should be charged it is the officer who lost the gun in the first place.
Garcia-Zacatecas is a lost soul trapped in a Kafkaesque nightmare, he is guilty of being in the wrong place at the wrong time. I hope he is released and I wish him peace.

It is gateing with political motive and federal animus towards immigrants as evidence of that motive.

Just because President Rump doesn't like him, doesn't mean we need to like him.
He's a bad guy who had a stolen gun and pulled the trigger in a crowd.
Don't fall into the trap of defending this idiot.
