Lawyers spar over relevance of questions as Nebraska PSC's Keystone XL hearings begin

Source: Omaha World Herald

By Paul Hammel

LINCOLN — Lawyers argued frequently over the relevance of questioning as the state’s hearings over the proposed Keystone XL pipeline began Monday.

Only one witness testified during the Monday morning session, but Dave Domina, the lawyer for landowners opposed to the pipeline, used his questions to raise concerns about liability for problems with the pipeline and whether TransCanada even intends to proceed with the project.

In recent weeks, TransCanada officials have said they will decide in December whether to proceed with the $8 billion project after learning how many oil producers will sign 20-year contracts to use the 36-inch pipeline.

Low oil prices, cooling of oil production in the oil sands region of Canada and the advent of other competing pipelines have raised doubts about whether the Keystone XL project, first proposed nine years ago, is still needed.

The five elected members of the Nebraska Public Service Commission are charged with determining whether TransCanada’s proposed route across Nebraska is in the public interest.
