Ohio officer charged with murder pleads not guilty, released on bond

CINCINNATI (Reuters) - A former University of Cincinnati police officer charged with murder in the shooting death of an unarmed black man he had stopped for a missing license plate was released from jail on bond hours after an initial court appearance on Thursday.
Ray Tensing, 25, had pleaded not guilty in the death of 43-year-old Samuel DuBose before Hamilton County Court of Common Pleas Judge Megan Shanahan, who set his bond at $1 million.
Tensing was released from jail later on Thursday, according to the Hamilton County Clerk of Courts. His next court date was set for Aug. 19.
Tensing was indicted on Wednesday on murder and voluntary manslaughter charges in the July 19 death of Samuel DuBose, who was shot in the head during a traffic stop. Tensing, who turned himself in and spent the night in jail in isolation, appeared in court in gray, striped prison clothes.

Mr. DuBose pulled away and his arm was caught in the car and he got dragged.
A police report stated Tensing said he was almost run over by the driver and was forced to shoot the driver.
However, Hamilton County Prosecutor Joe Deters said Wednesday that Tensings claim was a lie and that Tensing had fallen backward after shooting DuBose in the head.
This is the most asinine act Ive ever seen a police officer make, Deters said. It was unwarranted."

Even on the gun boards that I participate in, which are wildly pro-law enforcement, this is almost universally considered a bad shoot. What is debated is what the appropriate charge and punishment.
My prediction:
He will be convicted of voluntary manslaughter and serve roughly 10 years. The defense, while they may be claiming "self-defense" now, will end up in a plea deal in which the officer admits he had a negligent discharge of his firearm in the process of trying to get the guy out of the car. He also admits to making up a cover story after freaking out over the discharge. Poor choices, poor gun handling, not murder. Family is awarded multi-million dollar settlement. During the civil lawsuit, victim is dragged through the mud to try to reduce the payout amount. Dash cam footage becomes regular part of training at police training institutes to highlight "how to not let a traffic stop turn from humorous interaction to prison sentence in three seconds or less".
Rationale: it's going to be hard to prove intent to kill. The only thing that supports the intent to kill is the fact that the officer lied about the shooting afterwards, but those lies can be explained also by fear of the consequences of a negligent shooting. The DA will make this plea in order to avoid risking a trial result in which the jury finds the officer guilty of an even lesser charge (involuntary manslaughter).

(18,124 posts)walks free, a POC makes a forced traffic infraction, goes to jail and is found dead in her cell. We see who's life matters in this case. He should never walk free again. BUT, he's part of the privileged class, all perks and exceptions will be granted. Won't be surprised if he skips bail. Wonder if he has to wear one of those GPS locators? Naw. He's special, he's a police officer, people are even trying to pay his bail....wait, he got bail. This is a country FULL of racist pigs....
