I have never visited this area, but I have been to Native American sites in Colorado and New Mexico. There are some beautiful lands there with simply amazing historical dwellings. The callous disregard for these sacred lands is appalling.

UTE INDIAN TRIBE FILING LAWSUIT CHALLENGING PRESIDENT’S PLAN TO ABOLISH BEARS EARS NATIONAL MONUMENT
Ft. Duchesne, UT December 4, 2017

The Ute Indian Tribe is deeply offended by President Trump’s announcement today that he plans to significantly shrink the Bears Ears National Monument. His action will effectively revoke the Monument and threaten the Tribe’s cultural and historical resources that were protected by the designation of the Monument. Along with the 4 other tribes who came together to advocate for establishment of the Monument, the Ute Indian Tribe will be filing a lawsuit against President Trump, Secretary Zinke, and others in the Federal District Court for the District of Columbia to hold them accountable for their actions in this matter that serve as an affront to the sovereignty of the Ute Indian Tribe and all Tribes in the United States.

The President’s actions are even more appalling in that they were taken without even visiting the Monument or consulting with the tribes whose sacred and cultural sites the Monument was created to protect. Instead the President is relying on Secretary Zinke’s brief review that seeks to diminish the position of Tribe’s in favor of special interest groups. The proposal to shrink the Monument will leave hundreds of thousands of antiquities, archeological sites and cultural resources unprotected and eviscerate the years of collaborative work that was undertaken by the members of the Bears Ears Inter-Tribal Coalition to establish a monument that recognizes the unique cultural and spiritual contributions that Native peoples have made to the history of this great Nation.

The President’s action will upend almost a decade of collaborative work by local tribal members and the five tribes. “The President promised to drain the swamp,” said Luke Duncan Chairman of the Ute Indian Tribal Business Committee, “but with this unilateral action at the request of a few powerful Utah politicians the swamp is only getting deeper.” Chairman Duncan continued, “We refuse to become the forgotten people of this land and the President should recognize and respect our voice in this matter as the first Utahns.”

The President’s action to appease Utah politicians comes at a crucial time for Congressional approval of the President’s tax cuts and appears to be nothing more than a duplicitous effort to ensure that Senator Orrin Hatch’s objective of eliminating the Monument is fulfilled so that the President can secure support from Senator Hatch for the President’s tax reform initiative. The success of the President’s tax reform initiative hinges upon Senator Hatch’s support given his position as the Chairman of the Senate Finance Committee. Despite promises to work on behalf of Tribal Nations, the President is acting on behalf of wealthy special interest groups to advance their interest regardless of the impact on tribal history and culture.

The President’s action threatens the priceless resources of Bears Ears. “The Monument isn’t just about a few isolated artifacts. The Monument is a living part of our culture as well as the history and culture of the United States. Our cultures are still here and still thriving,” said Shaun Chapoose, member of the Ute Indian Tribal Business Committee. “The Bears Ears region is a cultural landscape – a place to nurture our families in our traditions. It’s a sad state of affairs when the President of this great Nation shows manifest disregard for our history and culture as a people, but we are prepared to fight for our rights, and to protect Bears Ears.”

The Ute Indian Tribe maintains that the Antiquities Act does not give a President the authority to revoke or shrink an established National Monument. It is the position of Ute Indian Tribe that President Trump’s plan to shrink Bears Ears constitutes an unlawful revocation of a National Monument and his actions in this matter should be universally condemned by all indigenous peoples of the world and those that support indigenous peoples rights. The President’s action in this matter violates the Antiquities Act and is being carried out without legal authority. The action also runs afoul of the Federal government’s trust responsibility and government-to-government relationship with Indian tribes. The Ute Indian Tribe will be filing a lawsuit challenging the President’s action with the other Bears Ears tribes as soon as the action is executed.

SALT LAKE CITY – On Dec. 4, President Trump signed a proclamation to reduce the Bears Ears National Monument in southeastern Utah. The decision was met with widespread opposition from Navajo leadership.

“The Navajo Nation has made repeated requests to meet with President Trump on this issue. The Bears Ears Monument is of critical importance, not only to the Navajo Nation but to many tribes in the region,” President Begaye said. “The decision to reduce the size of the Monument is being made with no tribal consultation. The Navajo Nation will defend Bears Ears. The reduction in the size of the Monument leaves us no choice but to litigate this decision.”

“Bears Ears National Monument is not just for Native Americans but for all Americans,” Vice President Jonathan Nez said. “This is a sad day for indigenous people and for America. However, we are resilient and refuse to allow President Trump’s unlawful decision to discourage us. We will continue to fight in honor of our ancestral warriors who fought for our way of life, for our culture and for our land too.”

The Monument was declared by President Obama on Dec. 28, 2016, pursuant to his authority under the Antiquities Act. The area encompassed by the Monument has been home to Native peoples since time immemorial.

As a part of the Bears Ears Inter-Tribal Coalition, the Nation has worked diligently to establish the Monument and ensure that management is guided in part by the Commission, created by the original proclamation and made up of the Hopi, Uintah and Ouray Ute, Ute Mountain Ute, and Zuni Tribes.

The Navajo Nation and the Commission have engaged to protect the area due to its cultural, religious and historical significance.

The Navajo Nation along with the four other tribes represented on the Commission, a coalition of nonprofits and citizen groups have consistently rallied to defend the Monument. The tribes will collectively be filing a lawsuit against the administration.

Salt Lake City, UT – In response to President Trump’s proclamations today that eviscerate Bears Ears National Monument and Grand Staircase-Escalante National Monuments, Southern Utah Wilderness Alliance Executive Director Scott Groene issued the following statement:

“Today’s illegal proclamations by President Trump represent the single greatest attack a president has ever launched against America’s federal public lands. It is certain that the legacies of both President Trump, and Sen. Orrin Hatch, who goaded him into this despicable act, will be forever tainted by their assault on more than two million acres of Utah’s wild lands that are beloved by the American public.”

“SUWA is committed to defending these monuments in court, and confident that today’s political action will be overturned. Bears Ears and Grand Staircase-Escalante National Monuments will be restored to their full glory, and President Trump’s action today will be remembered as another failed attempt to thwart the will of the American people, who want these lands to remain protected.”

With regard to his attack on Grand Staircase-Escalante National Monument, Trump divided it into three smaller sections totaling roughly 1 million acres, (a 48% reduction [900,000 acres less]) than the original monument.

“By eliminating nearly half of Grand Staircase-Escalante, President Trump has opened up some of the most wild and scenic redrock canyons in Utah to the lost cause of coal mining. For 21 years, the protected Grand Staircase-Escalante National Monument has inspired families to reconnect with the wild and with each other, has reinvigorated surrounding communities, and lead to significant paleontological discoveries. It has even been affirmed and ratified by Congress. Trump’s grandstanding disregards the success of this monument, merely because Sen. Hatch instructed him to.”

With regard to his ferocious attack on Bears Ears National Monument, Trump replaced it with two, much smaller, non-contiguous units totaling less than 230,000 acres (an 83% reduction [1.15 million acres less] when compared to Bears Ears).

“President Trump’s decimation of the Bears Ears is just the latest in a long string of insults he has lobbed toward Tribes, five of which worked diligently for years to ensure the protection of their cultural homeland.”

On Wednesday, December 28th, 2016, President Obama used his authority under the Antiquities Act to designate Bears Ears National Monument in southeastern Utah.

The President’s action granted a new layer of protection to some of the most spectacular places in southern Utah. There is of course Cedar Mesa, with its incredible canyons running toward the San Juan River. There is White Canyon to the west of Natural Bridges. There are the Bears Ears themselves and the high ponderosa forests of Elk Ridge. To the north there’s Beef Basin and Indian Creek. The new monument withdraws Lockhart Basin, adjacent to Canyonlands National Park, from future energy leasing. Nearly 100,000 archaeological and cultural sites are now covered by the proclamation, including House on Fire and Moon House ruins.

Equally important, the proclamation elevates the voices of the Native American tribes who have ancestral ties to the region. The Bears Ears proposal was led by five Tribes—the Navajo, Hopi, Zuni, Ute Mountain Ute, and Ute Indian Tribes. For the first time in American history, these Tribes will have a greater say in the management of these culturally important lands.

NARF Files Suit to Protect Bears Ears
December 4, 2017

President Trump’s action to revoke and replace the Bears Ears National Monument is not only an attack on the five sovereign nations with deep ties to the Bears Ears region, it is a complete violation of the separation of powers enshrined in our Constitution. No president has ever revoked and replaced a national monument before because it is not legal to do so. Only Congress may alter a monument. In light of this blatant violation of law, the Native American Rights Fund, representing the Hopi Tribe, Pueblo of Zuni, and Ute Mountain Ute Tribe filed a lawsuit today to protect Bears Ears. (Download the complaint filed December 4, 2017.)

Five tribes—Hopi Tribe, Navajo Nation, Pueblo of Zuni, Ute Indian Tribe, and Ute Mountain Ute Tribe—led the effort to establish the Bears Ears National Monument, an area still used for cultural and religious purposes. Increased looting of the estimated 100,000 plus structures, sites, and objects within every reach of the monument dictated the need for protections in the form of a monument designation.

According to NARF Staff Attorney Matthew Campbell, “Bears Ears is one of the most important places for Indian Country, and that is why Indian Country came together to advocate for this important place. Trump’s attack on Bears Ears is an attack on all of us, and we will fight to protect it.”

NARF Staff Attorney Natalie Landreth said “The Administration is not telling the truth. The Bears Ears monument as created by President Obama preserved hunting, fishing, gathering and grazing rights, and protected these incredible lands from widespread looting and oil, gas and mineral development.” No matter what the President said today, his action does the opposite: by its own terms, in 60 days the revoked lands are open to “entry, location, selection, sale” and “disposition under all laws relating to mineral and geothermal leasing” and “location, entry and patent under mining laws.” Landreth continued, “this is taking public lands that belong to the American people and selling to the highest bidder, there is just no other way to understand it.”

This latest action follows on the heels of the Administration’s other actions against Tribes: (1) issuing the permit to the Dakota Access Pipeline, (2) issuing the permit to the Keystone XL, and (3) revoking the Executive Order to protect the Bering Sea on April 28th. Tribes vigorously opposed all of these efforts. The Administration uses the term “tribal sovereignty” but clearly does not understand what that means.

Former President Bill Clinton denounced President Donald Trump’s decision to shrink Utah’s Grand Staircase-Escalante and Bears Ears national monuments, saying it was a bad move in multiple ways.

Clinton prefaced his remarks by recalling his contentious choice to protect Grand Staircase-Escalante during his presidency — and the positive feedback he got for it five years after — and said he was “mystified and heartbroken” about the recent cuts.

This week, following the outrageous and illegal repeal of Grand Staircase-Escalante and Bears Ears National Monuments by President Trump, Utah’s representatives in Congress doubled down on the effort to unprotect these iconic landscapes by introducing two bills that would essentially ratify Trump’s actions.

On Wednesday, Rep. Chris Stewart introduced H.R. 4558, a bill that creates three new national monuments—Escalante Canyons, Kaiparowits, and Grand Staircase, respectively. These monuments match the 48 percent reduction of the original Grand Staircase-Escalante National Monument perpetrated this week by Trump’s Executive Order, but the language nullifies Trump’s proclamation in favor of that of the bill. The bill also creates the so-called “Escalante Canyons National Park and Preserve,” but puts management planning for that park and the three national monuments in the hands of local officials in Kane and Garfield County despite the fact that these are federal lands belonging to all Americans.

All of the new designations prioritize recreation, hunting and grazing over conservation, and the bill reopens the lands not included in the Trump monuments to mineral leasing. The bill also includes a public lands giveaway, handing the Hole in the Rock Road to the State of Utah, and will likely reopen destructive off-road vehicle routes that have been closed for decades to protect sensitive resources

“This bill is a brazen handout to the extremist voices who wish to eliminate federal control of public lands that belong to all,” said Scott Groene, Executive Director of the Southern Utah Wilderness Alliance. “Though it purports to protect these landscapes, by handing control almost exclusively to development interests in Kane and Garfield County, it is clear the remnants of Grand Staircase-Escalante would become playgrounds for destructive recreation, poor lands management and dirty energy. The bill, with its throw away National Park designation, is a bait and switch. No one should bite.”

The other bill, H.R. 4532, introduced Tuesday by new delegation member Rep. John Curtis, alongside Reps. Bishop, Stewart and Love from the Utah delegation, ratifies the new boundaries that Trump’s proclamation put forth for Bears Ears National Monument, replacing the Bears Ears with two significantly diminished landscapes: the 142,337-acre Shash Jáa National Monument, and the 86, 447-acre Indian Creek National Monument. These new boundaries are an 83 percent reduction in the original Bears Ears National Monument.

Like the Escalante bill, Rep. Curtis’ bill creates a new management council comprised of the same local elected officials that sought the undoing of the monument, as well as members of Tribes who are picked not by Tribal governments, but by the Utah delegation. Furthermore, the bill excludes thee of the five tribes who advocated for protection of Bears Ears from the council. This framework ensures that the protective status of the original Bears Ears National Monument will not be honored in these newer, decimated parcels.

“The fact that these bills even exist is evidence that the Utah delegation knows Trump’s actions were illegal, and they are scrambling to set up a Plan B,” Groene said. “But the two million acres of lands that Trump stripped from the original Bears Ears and Grand Staircase-Escalante National Monuments still belong to all Americans, and we will work with our allies in Congress, who are more motivated than ever, to ensure that neither of these efforts to hand over these national treasures ever see the light of day.”

We write today with devastating news – President Trump made an unlawful and unilateral move last Monday to revoke and replace Bears Ears National Monument. In doing so, he attempted to remove monument protections from more than a million acres of lands in the Bears Ears cultural landscape.

Despite multiple requests, President Trump made up his mind and acted without meeting with our Tribes whose cultures, lands, and history Bears Ears National Monument is intended to protect. Our cultures are still here and still thriving. The Bears Ears region is a cultural landscape – a place to nurture our families in our traditions. President Trump’s arbitrary proposal to eliminate protections for sacred lands leaves tens of thousands of historical and cultural sites vulnerable to looting and grave robbing, fossil fuel development, and uranium mining.

The president’s proposed unilateral action pleases a few powerful Utah politicians, a direct contrast to the government-to-government negotiations and compromise with the previous administration, state, and local officials that brought about Bears Ears. The president’s course of action was without respect for the Native Americans that worked for decades to protect these resources, and it makes a strong statement to Tribes across the nation that Native American values and interests are not important to the Trump administration. In addition to being a shameful attack on tribes, President Trump’s action also is without legal standing and it will not stand.

All of our five tribes immediately filed litigation to correct the grave injustice that has been visited upon not just our tribal members, but the American public. Bears Ears National Monument is not just for Native Americans, but for all Americans.

San Juan County is celebrating President Trump’s Monday decision to shrink Bears Ears National Monument by 85 percent. By San Juan County I mean the county’s conservative leadership, not the majority of its residents. Polling data on rural reservation land is virtually non-existent so all we know is that the loudest voices in the county oppose the monument — and the loudest voices in the county tend to belong to a particular race and religion. But unlike Utah as a whole, white Mormons are in the minority in San Juan County, which is over fifty percent American Indian.

So even as the county leadership celebrates victory in their battle against the federal government this week, they’re shaking in their boots. And they’re beginning to lash out. The county is in the midst of a lawsuit which found it to be in violation of the Voting Rights Act for systematic discrimination against Navajo residents in county commission and school board elections. If the judge overseeing the case rules that the county must be redistricted — and it looks likely he will — then the county commission and school board could become majority Navajo for the first time ever.

Before the new districts have even taken effect, the commissioners are claiming that the lawsuit will amount to discrimination against the minority white residents. But as the Salt Lake Tribune reports, that line of reasoning probably won’t work.

Monte Wells, who was arrested in 2014 with county commissioner Phil Lyman for leading an illegal ATV protest ride that resulted in hundreds of thousands of dollars in damage to archaeological sites, has been lashing out lately against assertions of Native American sovereignty. Wells is the proprietor of the Petroglyph news site (which mostly traffics in lame, gotcha “journalism”). In a recent Facebook post, he called Navajo Nation president Russell Begaye “racist” and said Begaye should remember “who conquered who.” Not exspecially (sic) words of piece (sic) and healing.

Bears Ears lawsuits

1. Hopi Tribe et al v. Trump et al

• Filed: Federal district court in D.C.

• Plaintiffs: Five American Indian tribes (Hopi, Navajo, Ute Indian, Ute Mountain Ute, Zuni).

• Defendants: President Donald Trump, Interior Secretary Ryan Zinke, acting Bureau of Land Management Director Brian Steed, Secretary of Agriculture Sonny Perdue, U.S. Forest Service Chief Tony Tooke.

• Argument: Under the Antiquities Act of 1906, the president does not have the legal authority to revoke or modify a monument — only to designate one. Additionally, the tribes say the 1.35 million acres set aside by President Barack Obama holds spiritual significance and contains cultural artifacts that deserve protection at the threat of looting, grave-robbing, vandalism and development.

• Seeking: Injunctive relief “requiring President Trump to rescind his proclamation, or prohibiting him from enforcing or implementing it in any way.”


2. Utah Dine Bikeyah et al v. Trump et al

• Filed: Federal district court in D.C.

• Plaintiffs: A broad coalition representing American Indian tribes, recreation interests and paleontologists (Utah Dine Bikeyah, Patagonia Works, Friends of Cedar Mesa, Archaeology Southwest, Conservation Lands Foundation, Access Fund, Society for Vertebrate Paleontology, National Trust for Historic Preservation).

• Defendants: Trump, Zinke, Steed, Perdue, Tooke.

The retraction of these protections is yet another broken promise to the tribes and a careless regression of respect. From the loving traces of mothers, fathers, and children, to the innovation and ingenuity of past populations, the Bears Ears is saturated with a history too fragile to mishandle.”
