Twitler had won the election by Dec 22nd, he was a month away from assuming office.

I presume that acting as President before you're actually President is frowned upon, but what law does it break?

with foreign affairs. Trump had no right to be talking to the Russians regarding the the sanctions until after he took the oath of office.

Remember that Reagan's people interfered with the Carter Administration's efforts to deal with the Iranian hostage situation? It did a lot of harm to Carter's re-election efforts.

Senior advisors told Flynn to contact the Russians. Up until now everyone has been lying about it. Trump fired Comey because he wouldn't drop the Flynn investigation.

...PRIOR to the election.

This included material help for the campaign by the Russians and receipt of stolen property (the hacked DNC emails) by the Trump campaign through an intermediary (Wikileaks). Both of these things are criminal in nature. Mueller needs to flip the lower level participants without triggering a constitutional crisis i.e. Trump issuing everyone a blanket pardon and daring Congress to impeach him before the case is fully made. I see this as one more move to box in the principals so that when Trump issues the pardons the evidence is so overwhelming that even the partisan Congress cannot ignore it. Even now, there are people on the right saying that Flynn lied to the FBI, but there was no underlying crime so Trump is in the clear.
