Welcome to Donald Trumps America.
This woman felt entitled to sit on the car of complete strangers, shout angry (if slurred) profanities at them, demand to see their licenses, and pull a citizens arrest on them.
Their crime? Being brown in her Southern California neighborhood.
For millions of Trump followers, this is acceptable behavior and that is horrifying. This woman looks like a maniac, and she is. Not because she sounds drunk and out of control; but because she is acting on an impulse of hatred.

As you know, the area between CA-55 (Costa Mesa) and CA-78 (Escondido) is practically a right-wing confederacy.
There are many exceptions (I was among them); but most voters in that area tend to be your Orly Taitz-clapping, "anchor baby!" yelling Republicans.

If she does indeed live in Chino, you'd think she would have learned to coexist with Mexican Americans by now; they are, after all, a majority there (54%, according to the last census). The woman's probably scared of her own shadow.
Anyone living ANYWHERE in California should be very used to Mexican-Americans and any other latino people! My own maternal side of the family has been in California since 1900, and we have several latino people interwoven into it. My ex-husband also just found out that his birth father was Mexican-American, and this particular Mexican family from Durango had been in the US for around the same amount of time as ours.
She sounds like a nasty Trumper for sure!

(21,713 posts)Even the "whitest" cities in SoCal have sizable Hispanic communities - as well as Asian and Middle Eastern. California truly is the nation's melting pot, and in many ways (certainly not just ethnological) the face of America's future.
For some, that's just too painful a thought. They'd do well to a) take a chill pill, and b) remember that the only thing certain in this world of ours, is change.

(100,139 posts)I live at the north end of CA-55 and I regularly see idiots with Trump signs and bumper stickers, and the occasional American flag flying out the back of a giant pick up truck. Most of my neighbors have drank the Fox News Kool-Aid.

I always felt it was a shame that, amid such appealing surroundings, these Republicans could't learn to mellow a little.
Then again, Republican and mellow are seldom found in the same sentence.

(5,611 posts)have been starting to suffer from signs of dementia in the last two years (they happen to be a married couple so that makes things even worse). They would never have voted for/supported Trump at any other time as they always voted democrat and would normally find his racism-mongering and many other nasty traits reprehensible.
But they act in just insane ways when it comes to Trump now (in addition to other news issues related to dementia like extreme paranoia) -- they aren't religious people at all but treat him like a cult leader. They act like he's above criticism, that believe every word he says and have adopted his concerns entirely (especially immigration), etc.

The least we can do if we possess any decency whatsoever is make it impossible for racist garbage like this to spew their hateful filth in the public square. Besides, hate speech laws haven't made Western Europe any less democratic or progressive. In fact, they put us to shame. We should be so "undemocratic".

It is important to note that actual force is not necessary. While locking someone in a car or in a room or otherwise blocking their exit is relatively clear-cut, an implied threat of force is also enough to prove intent. An example would be threatening to injure a party if they attempt to leave, even though the exits are not blocked.

A quick look at CA law shows this would be more likely be false imprisonment, as the distinction in CA appears to be its false imprisonment if you detain someone from leaving or kidnapping if you forcefully move them to another place.
However I am not clear enough on the case law to see if just blocking a vehicle from leaving is enough for the charge, if you don't prevent the person from leaving and walking away. It may be, but on that same hand if so that would allow any protesters who block traffic to face the same charges so it may not be.... every state is different enough that it's hard to know unless you have worked and been training in the details for that state.

(2,143 posts)The info I posted relates to a tort (civil law) claim the driver and passenger might have against the woman blocking the vehicle. Yes, both criminal and civil laws differ from state to state.

(6,324 posts)For a civil claim you need to prove damages or harm. For such a brief encounter where there wasn't physical contact or harm it would be a tough case to bring to trial and win.

(2,143 posts)Sometimes one wants to take a stand for a principle. A $1 judgment and attorney fees would be worthwhile to make a point. The harm is the car occupants' delay of their right to proceed.

(2,143 posts)It's true that Taylor Swift has deep pockets with which to hire private counsel. The ACLU, SPLC, Legal Aid and/or other organizations and/or large law firms might be glad to volunteer to take a case such as this pro bono.

(6,324 posts)They all don't have deep unlimited pockets. Especially legal aid, they turn away much, much more valid cases than this because of lilies resources.
The SPLC and ACLU concentrate their efforts on high profile cases and ones where a victory will actually produce a real impact. Taking a case of dubious merit in the first place just to make a statement against one unhinged loser isn't on their priority list. Now if this person was a high profile leader of a white nationalist group and going after them would have an impact on the wider group and send a message that might get the SPLC interested. Your garden variety neighborhood racist trash isn't.

(2,143 posts)Just as Taylor Swift recently sued successfully for $1 damages in a civil court case against a wrong-doer, it would be good to see this vigilante and others with similar lawless beliefs learn that they can't harass fellow citizens who are innocently going about their lives on American streets.
