be accessed from the Freedom of Information Act.
I don't see why that information would be classified.

A. The Scope of the Freedom of Information Act
All IRS records are subject to FOIA requests. However, FOIA does not require the IRS to release
all documents that are subject to FOIA requests. The IRS may withhold information pursuant to
nine exemptions and three exclusions contained in the FOIA statute.
The Freedom of Information Act applies to records either created or obtained by an agency and
under agency control at the time of the FOIA request. Agencies within the executive branch of the
federal government, including the Executive Office of the President and independent regulatory
agencies are subject to the FOIA. State governments, municipal corporations, the courts,
Congress and private citizens are not subject to the FOIA.

(12,344 posts)Mueller can subpoena the returns, but that still doesn't make them FOIAable. The only way they will ever be oublic is if introduced as evidence in a legal proceeding.

(9,874 posts)If Mueller gets the tax returns it will be under grand jury subpoena and he cannot disclose them because they are protected by the secrecy of the grand jury process and the rules of criminal procedure. Even if there were an indictment and trial they could not be released, unless at the time of trial they are entered into evidence.

(22,464 posts)seeing it may be able to figure out a way of of getting the returns. All Grand Jury information is not necessarily closed to the public and there might not be a Grand Jury set up when they are requested.
Congress has already requested the information but I can't see what came of that.

Also the president is not a private citizen, he is the Commander in chief so, according to the requirements I posted he is not protected as a private citizen would be with regards to their tax returns.
And, if it is being used in a criminal investigation I think it could be gotten then also.
