extra help?
I wouldn't want to be him.

I also understand human nature and even though he will have a lot of power it will never be lost oh him that he was not duly appointed like the rest of them

(5,730 posts)Fuck him and all of the Repubs who are so partisan to change the rules and to deny Obama's appointment a hearing for a year. They are reprehensible. Beyond redemption.

Alito got in 52-48 so I doubt it's going to bother him that very much.

(13,485 posts)that none of them like him. Just my suspition. Wouldn't it be a great dream.... if the other judges made decisions that made sure he wasn't a deciding vote on any issue. It would be like a 7 judge SCOTUS. There are a couple of ways they could pull it off. Just a pipe dream.

(4,835 posts)But justices can do surprising things. Remember Roberts didn't rule completely against Obamacare, and sided with the liberals on marriage equality.
Once they're there, they can surprise us. The bigger concern is the age of the liberal justices. I hope they can hang on.

(42,581 posts)I doubt you'll find many supporters of the filibuster among judges or others who have to go through the confirmation process.
And as for the fact that the Court just reversed one of his decisions unanimously isn't going to phase him any more than it phased any other justice who experienced the same thing (including Justice Sotomayor).

(42,581 posts)Whether you think the filibuster is a good thing depends on where you're sitting. Progressives hated it and wanted its use limited when it was employed to block civil rights legislation. We hated it when it was used to block Obama's nominees. We like it now that it could be used to block Trump's nominees. Not judging, just reporting.
By the way, there are constitutional scholars who have argued that the filibuster is unconstitutional. In 2012, Common Cause, along with several Democratic members of the House who had voted for the DREAM Act and DISCLOSE Act only to see it blocked by a republican filibuster in the Senate, filed a lawsuit seeking to have the filibuster declared unconstitutional. They lost when the court of appeals held the plaintiffs lacked standing (thus making it unnecessary for the court to reach the constitutional issue.)
