I'm sure their backers have deep enough pockets to weather a lawsuit.

Here in Oklahoma as long as one party knows they are being recorded then it is legal.

If I have a hidden camera on me and film you in Oklahoma it is perfectly legal because I know we are being recorded. In some states both people have to agree to be recorded or it is a violation of wiretapping laws. Each state is different but here is a twist it's only for audio that it would be illegal video without sound is always legal if you are in a public place.

For video, no consent is required, even in places where audio recordings would be illegal. See: nanny cams

For audio, California is a two-party consent state. But since it occurred in a crowded restaurant, no consent is needed, as there is no expectation of privacy.

At any rate, as the video isn't going to court, it doesn't matter. Surely its bad manners, but they have every right to go to the media with it.
