WFTV.COM
But Sheaffer said there could be another explanation for Martin's knuckle injury.
It could be consistent with Trayvon either trying to get away or defend himself, Sheaffer said.
Zimmerman shot and killed the unarmed teenager almost three months ago after calling 911 to report the teenager was acting suspiciously.
Zimmerman said Martin threw the first punch and that he opened fire in self-defense after his screams for help went unanswered.
The FBI was not able to determine whether it was Zimmerman or Trayvon who could be heard crying out for help in 911 calls.
The defense is trying to decide what evidence it wants a judge to keep confidential before the media gets a chance to see it, but WFTV is being told that could happen in the next week or so.
In the meantime, theres new information surfacing about Zimmerman.

(5,420 posts)This whole thing still boils down to who the aggressor was. By his own acount with the police it is obvious who was doing the chasing and who was defending themselves. Sounds to me like badass Zimmerman attempted to kick the boys ass and when he learned that Trayvon was not going to just let him do it and he Zimmerman was going to get his ass kicked, he killed the boy.

(32,139 posts)This is how the whole event started. Why the hell was a white adult male stalking a black teenager? It's not like it was on Zimmerman's property.
Of course the boy had the right to defend himself - he was stalked and/or attacked.

(39,215 posts)follows on foot, I would be afraid. What is your definition of a stalker?
magical thyme
(14,881 posts)Plain and simple.
Until you've been stalked by a strange man in a car (and I have) you have no idea how very threatening that is.
And if Trayvon did turn and confront him, then his response was the same as mine was when I was stalked by a strange man in a van some 20 years ago. Rather then let him find out where I lived, I doubled back and confronted him. He was still in his van, however, parked in a lot and yelling something at me. When I approached him and demanded to know what exactly he wanted, he turned bright red and gunned it outta there. Left about half his tires in the lot, too. Fucking coward. Stalkers are fucking bullying cowards.

Lucky for you the cops happened to be so close by and didn't get caught in a traffic jam!
After I left the convenience store, mine drove past me on the main road and yelled something at me. A minute later, passed me going the other way and yelled something at me. And back and forth again and again. And then I turned down a side street and he turned, passed me there and yelled something. And then again, the other way.
Just after I turned into the side-side street that led to and apartment complex and 2 condo complexes, he pulled into a parking lot at that corner and yelled something at me. I was sweating bullets by then, totally panicked.
Nowhere to run. Nowhere to hide. And then a little switch turned in my brain, and I morphed from primal fear into primal rage. That's when I doubled back and confronted him.

Too bad Trayvon did not have a chance to be far more aggressive when he attempted to defend himself. A mere broken nose and a few scratches is not enough to stop an armed, crazed stalker who is determined that you 'won't get away'.
All this does is to show that Trayvon feared for his life, and that his fears were justified, he is dead, is he not?

(202 posts)that Zimmerman planned to kick his ass. Zimmerman called 911 numerous times and not once did he confront anybody but somehow this time he was out looking for a fight. Just doesn't add up.

(24,634 posts)That says to me, he wasn't going to let this one get away BECAUSE of the numerous times he's called 911 before. So he was planning on doing something. Deny, it all you want. This makes perfect sense that Zimmerman was looking to instigate something.

(46 posts)I just don't get it. Since Zimmerman had the gun, why wait until he was on the ground getting pummeled to use it? If he was afraid of Trayvon, why wasn't he holding it when Trayvon advanced on him? If Zimmerman advanced on Trayvon, he apparently wasn't carrying it then either. It's only when Zimmerman is on the ground getting hit in the head and face that he fires upwards at Trayvon. So many people are saying that Zimmerman was "gunning" to get this guy...if so, he wasn't holding his weapon.
I got asked while sunning myself at my condo's pool if I was a resident. A lot of non-residents were scaling the fence, using the pool, stealing property, and vandalizing the grounds. As I was a new owner, this member of the HOA didn't know me. I identified myself, made some small talk with the HOA member, and went back to my book. Maybe Zimmerman simply asked Trayvon if he lived there. With multiple burglaries and a recent home invasion, maybe...just maybe....he was looking out for his neighbors and Trayvon got upset and lashed out.
Doesn't sound like he was profiling at all, despite NBC's staff editing the 911 tapes to make it look like he was. I don't know...I'm just wondering if some guy was concerned for his neighbors and things went from bad to worse.

(17,865 posts)The only portion that might apply would be:
784.048 Stalking; definitions; penalties.
(2) Any person who willfully, maliciously, and repeatedly follows, harasses, or cyberstalks another person commits the offense of stalking, a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.
The key is repeatedly. This was a one off event.

(39,215 posts)strangers and to be feared. Zimmerman had called the police - that is all he was supposed to do. Beyond that he was the attacker.
magical thyme
(14,881 posts)he claimed that Trayvon circled his car repeatedly.
Which, naturally, begs the question why he did he get out of his car if he was so afraid?
He also claimed that Trayvon pinned his shoulders down. And had his hand over his mouth and tried to smother him. And repeatedly banged his head on the ground. And spotted the gun and tried to grab it. And then they wrestled for it.
Which, naturally, begs the questions how many hands did Trayvon have? And how was Zimmy screaming for help -- for 40 seconds on the 911 tape -- with Trayvon's hand over his mouth trying to smother him?
He also claimed at the hearing that after Trayvon had him pinned to the ground with hand over his mouth, etc. that he "managed to scoot away" and shot Trayvon from a short distance.
See, this is what happens when you lie, and then evidence turns up that conflicts with your lies. You start modifying your story to fit with the unexpected facts. And then more evidence, such as forensic evidence showing the angle and distance of the shot, conflicts with the new version. So you modify the story again, until it is a convoluted mess that is anatomically impossible and makes no sense.
And as Judge Judy says, "If it doesn't make sense, it's a lie!"
Occam's Razor, and my personal experience with being stalked by a strange man in a car, tells me that Trayvon may well have turned and confronted him. Trayvon may well have gotten off a lucky punch, knocked him down and he hit his head on the paved walkway between the townhouses. And that's when he pulled his gun, pointed it at Trayvon who started calling for help. And then shot him.
There was no heroic, insane wrestling match on the ground with an 8-armed Trayvon pinning him down, pounding his head repeatedly into the concrete, smothering him, spotting the gun and trying to wrestle it away from him...and so on.
As far as the profiling, I don't know what the definition is. But yesterday's news reports said the FBI is now interviewing witnesses as part of the Federal investigation as to whether this was a hate crime.

that Trayvon had to defend himself but since I do not know all the evidence it is possible. All current indications are that if Trayvon had not hit Zimmerman he would still be alive.

(14,881 posts)and met the police by the mailboxes, like they suggested he do, Trayvon would still be alive.
There are no indications that Trayvon's attempt to defend himself caused his death.
What caused his death was an out-of-control, armed self-appointed wannabe cop with a history of violence. Who btw used one addictive prescription drug that affects impulse control to get up in the morning and second addictive prescription drug to go to sleep at night. Both of which occasionally have the unfortunate side effect of mood swings, and both of which can cause withdrawal symptoms when stopped.

(17,865 posts)this story has drifted over time.
At first Zimmerman was much larger than Martin - that has demonstrated to not be the case. I would expect to see a a body double of Martin standing next to a puny Zimmerman (anybody doubt he has been losing weight since the incident). Martin towered over him.
Martin was an angel who was only suspended for tardiness. Well that story has changed with drug residue and jewelry found on his person at school along with the statement that he was in an unauthorized location. It makes him look like a burgler.
His association with street fighting. Not proved to my satisfaction yet, but what if it is at trial?
Why didn't his father start looking for him the night before? That part has troubled me from the beginning.
I still think Zimmerman committed manslaughter, but Murder is a stretch. Remember Zimmerman does have the right to walk and even follow someone (as creepy as it sounds) in his neighborhood. He even has the right to approach an individual and ask that person what they are doing in the neighborhood (remember Martin is a guest and not a resident). It is a profoundly stupid thing to do but not illegal and not necessarily an aggressive act.
It will come down to the screams on the 911 tape and how believable Zimmerman is on the witness stand.
I personally think that Zimmerman tried to detain Martin and Martin responded. Proving that may be difficult. The next step is whether you are justified in shooting someone during a fist fight. Did Zimmerman give up his stand your ground rights by his prior actions (following and possibly detaining). Even if he did he can still be justified if he is unable to escape the situation and is in danger.
Little Star
(17,055 posts)What rights did Trayvon have? According to many they only talk about Zimmerman's so called rights to kill this child. Fuck that!
magical thyme
(14,881 posts)Trayvon associated with street fighting? Perhaps you could provide a link?
Jewelry found on his person? Link?
There is a lot more evidence than the 911 tape. There are numerous witnesses, forensic evidence, medical reports, etc.
One new item that came out on Monday, when the prosecution provided the defense with its evidence, is videotape from a security camera at the complex in the proximity of the evening's events. We haven't seen that tape, so we have no way of knowing exactly what -- or who -- is on it, never mind what they're doing at the time.
On the other hand, Zimmerman's story has changed repeatedly and frankly is not very believable.
And the FBI apparently has seen enough to be interviewing witnesses to determine if it was a hate crime, which would bring separate charges and possible death penalty.
I don't think murder 2 is far-fetched at all.
obamanut2012
(26,181 posts)He was not found with jewelry on his person, nor was he "involved with street fighting," whatever the hell that's supposed to mean. I couldn't care less that he was found with an empty baggie that probably once had held weed.
And, his father DID start looking for him earlier than you say, but let's make believe he didn't: what the hell does that have to do with Travyon's murder???
People do not have a right to "follow" people, especially minors. I was taught that in my CCW permit class, by both an attorney and a police officer: you have a right to protect yourself from someone who will not quit following you. I myself called the police on a man who did that tome, and he was led away in handcuffs.
